Definitions of Human Trafficking “Trafficking in persons” shall mean the recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. Exploitation shall include, at a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs;” Palermo Protocol 2000

3. Definitions of Human Trafficking UNHCR (Guidelines 2006, Human trafficking) “Human trafficking is defined as a process that is a combination of three basic components: 1) Movement (including within the UK) 2) Control, through harm/threat of harm or fraud 3) For the purpose of exploitation

5. Types of Modern Slavery Types of exploitation that people may be trafficked for are:  Sexual exploitation  Domestic servitude  Criminal exploitation  Organ harvesting  Forced labour Homeless Link 2016

6. What you should know The Council of Europe Convention on Action against Trafficking in Human Beings This convention requires that potential and actual victims of modern slavery have specific entitlements to support. These include: 1.Material assistance 2.Access to psychological support 3.Access to legal advice and assistance 4.Counselling 5.Emergency medical treatment 6.Education for the victim’s children 7.Translation and interpretation services when appropriate. Identified adult victims of trafficking are entitled to the above for a period of 45 days. They must consent to referral and support respectively.

7. What you should know The Care Act 2014 The Act sets out a legal duty for Local Authorities to assess adults in need of care and support and meet ‘eligible needs’ in a way that promotes their wellbeing. This includes protecting adults from abuse or neglect. It requires Local Authorities and relevant partners (such as colleagues in health, housing and the police) to cooperate to safeguard adults in need who are at risk of abuse or neglect. It recognises exploitation, and specifically slavery and human trafficking, as a ‘form of abuse and neglect’. Homeless Link 2016; Human Trafficking Foundation 2015

8. Your response 1. Establish a Modern Slavery Lead in your organisation and ensure they sign up to the Modern Slavery Partnership for Hampshire and the Isle of Wight. 2. Ensure that a response to Modern Slavery and Human Trafficking is clear in your safeguarding policy. Help with this can be obtained by contacting the Modern Slavery Partnership coordinator via the Modern Slavery Partnership Website contact us page. 3. Find out if you are a ‘First Responder’ and if not, establish a relationship with a First Responder Organisation. 4. Ensure the potential victims knows their rights, options, and the potential support available. With consent, refer to the UK Human Trafficking Centre via the National Referral Mechanism (NRM). 6. If you are a ‘specialised agency’ and the potential victim doesn’t give consent for an NRM referral, you must refer specific details of the case to the Home Office using the ‘MS1 Form’.
