7 – Environment and climate change Chapter 27 – Environment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union TRANSPOSITION Marine Framework Strategy Directive is at very early stage of transposition (6%) with only a few definitions yet transposed. Transposition efforts are limited to the plan for adopting the new Law on the Protection of the Marine and Coastal Ecosystems by 2015.

8 Chapter 27 – Environment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27 – Environment and climate change IMPLEMENTATION  Implementation of the Marine Framework Strategy Directive is in an initial phase.  So far, only obligations arising from the Directive which are also related to implementation of the Barcelona Convention are implemented, for example, monitoring of sea waters and coastal area is performed in accordance with MEDPOL Programme, while strategic documents for the protection and preservation of marine environment have been developed covering LBS and SPA Protocol, Contingency Plan and Prevention and Emergency Protocol of the Barcelona Convention.  Full implementation of this directive shall be accomplished by 2017.

9 Chapter 27 – Environment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27 – Environment and climate change IMPLEMENTATION Monitoring Program  Monitoring program of the state of coastal sea ecosystem of Montenegro is programmatically and methodologically harmonized with requirements of: - National regulation: Law on Environment (Off. Gazette of MNE, n. 48/08), Law on waters (Off. Gazette of MNE, n. 27/07), Decree on classification and categorization of surface and ground waters (Off. Gazette of MNE, n. 02/07); - Relevant EU Directives, European Environment Agency Guide on transitional, coastal and marine waters (Eurowaternet technical guidlines), and related guidelines for reporting (WISE-SoE Reporting on Transitional, Coastal and Marine Waters), as well as requirements of MEDPOL program.

10 Chapter 27 – Environment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27 – Environment and climate change IMPLEMENTATION Monitoring Program  Monitoring program of the state of coastal sea ecosystem of Montenegro is composed of the following complementary programs: - Monitoring program of the quality of coastal, transition (brakish) and sea water - Monitoring program of eutrophication - Monitoring program of biological indicators and ecological indicators A. Defining bioindicators and ecological indicators B. Defining biomarkers of environmental pollution - Monitoring program of the quality of waters for mariculture and ecotoxicology of seashells A. Water quality testing B. Ecotoxicological test of seashells pollution - Program of testing the quality of waters in HOT SPOTS - Monitoring program of input rivers

11 Chapter 27 – Environment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27 – Environment and climate change IMPLEMENTATION Reporting  Steps for preparing and realizing Monitoring program: - Monitoring program is written by EPA; - Opinion of the Ministry; - Government approving; - Agency announces a call for tender.  Since 2008 Monitoring Program for Marine Ecosystem has been realized by Institute for Marine Biology from Kotor in cooperation with Center for Ecotoxicology research.  In October 2011, it was first time that EPA prepared reports for the marine ecosystem for EEA. That report contained following information: Temperature, pH, Electrical conductivity, Oxygen saturation, BOD5, Chlorophyll a, Secchi depth, Nitrate, Nitrite, Ammonium, Orthophosphates, Total Phosphorus, Total Nitrogen and Silicate for each of 8 station (Ulcinj, Bar, Budva, Mamula, Herceg Novi, Tivat, Risan i Kotor).

12 Chapter 27 – Environment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27 – Environment and climate change OPPORTUNITIES  EU integration process – ongoing and further harmonization of laws and capacity building.  Possibilities to build synergies with ongoing/ future projects and initiatives.  Sustainable development accepted as a prevailing development concept.  NSICZM is under construction in the framework of CAMP program.  ICZM Protocol signed, adoption of a Plan for Integrated coastal zone management.  Implementation of initiatives and projects that promote integrated management and ecosystem approach principals.  Special Purpose Spatial Plan for the Coastal Zone.  Development of common methodologies for determination of good ecological status.  Ongoing projects.....

13 Chapter 27 – Environment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27 – Environment and climate change OPPORTUNITIES  Montenegro is very active in transboundary and regional cooperation on marine protection, especially in the scope of the Commission for Protection of Adriatic Sea, Adriatic-Ionic Initiative as well as through Mediterranean Action Plan.  Montenegro has also been actively participating to the regional and sub-regional cooperation frameworks developed by the UNEP/MAP and the Barcelona Convention as well as by other sub-regional agreements (works of the Adriatic Commission).  RAC/SPA.

14 Chapter 27 – Environment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27 – Environment and climate change Ongoing Projects  CAMP Montenegro - Horizontal activities; - Institutional arrangements and coordination for ICZM and application of ICZM tools; - Establishment and management of protected areas (with special emphasis on marine protected areas): - Monitoring and information system; - Capacity building and awareness raising; - Pollution control and reduction.  ADRICOSM INTERMEDIATE - Master Plan for integrated coastal monitoring program; - Database for Montenegro EPA to manage monitoring data; - Training and technology transfer.  INTEGRATED MANAGEMENT OF THE BUNA/BOJANA BASIN, COASTAL AREA AND AQUIFERS (MedPartnership) MEDMPAnet.  “START UP OF KATIC MARINE PROTECTED AREA IN MONTENEGRO AND ASSESSMENT OF MARINE AND COASTAL ECOSYSTEMS ALONG THE COAST”. (Italian Ministry of Environment, Land and Sea).

15 Chapter 27 – Environment and climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27 – Environment and climate change Implementation challenges  Contents of the initial assessment: – Analysis of the essential characteristics (physical and chemical properties, habitat types, biological properties, hydromorphology); – Analysis of the main pressures and impacts, including human activity; – Economic and social analysis of the use of sea waters and costs of degradation In doing so: - take into account the assessment must be align to other EU legislation (Water Framework Directive) and conventions (Barcelona, CBD, ect.); - assessment methodology must be aligned to the marine region / sub-region considering transboundary impacts and transboundary features;
