3 Applicant Request The applicant is requesting to amend Policy 5.6.1 of the Future Land Use Element of the Comprehensive Plan (religious facilities) to allow for congregate living facilities as an accessory use. The applicant has also proposed a definition of “congregate living facility”.

4 Proposed Amendment Policy 5.6.1 Houses of worship, churches, or places of religious assembly shall be considered to be institutional uses. Religious facilities may be permitted in all land use categories designated on the Future Land Use Map. subject to performance criteria regarding minimum site size, scale, and dimensions, building coverage, parking, buffering, access, and other impacts. Congregate living facilities may be allowed as accessory uses to a religious facility subject to the Board of County Commissioners’ approval. The Board may allow the maximum density of the underlying future land use to be exceeded for accessory congregate living facilities. Religious facilities and accessory uses shall be subject to performance criteria regarding minimum site size, scale, dimensions, building coverage, parking, buffering, access and other impacts as listed in the Unified Land Development Code (ULDC). In addition to the proposed language indicated in Policy 5.6.1 above, the following definition of “congregate living facility” is proposed. A “Congregate Living Facility” is a shared living environment designed to integrate the housing and services needs of elder individuals. The goal of Congregate Living Facilities is to increase self-sufficiency through the provision of supportive services in a residential setting. Congregate Living Facilities are neither nursing homes nor medical care facilities.

7 Staff Recommendation Staff recommends that the Local Planning Agency recommend that the Board of County Commissioners deny item CPA-02-16 with the bases as noted in the staff report.
