Holders of a Legitimation Card Having a valid legitimation card AND Going into retirement You can apply for a „private“ settlement permit in the district office of the Municipal Department 35 (Niederlassungsbewilligung – ausgenommen Erwerbstätigkeit)

Time limits An application can be submitted during the term of your legitimation card or not later than 6 months after its expiry

Documents to submit Passport 1 new biometric photo Legitimation card Valid health insurance Statement on your (future) retirement pay Lease of your flat monthly payment for loan, flat, alimony,..... Address registration (Meldezettel) School certificates/degrees or German knowledge (at least A1 level)

Your new card: the settlement permit The settlement permit „Private“ is quota-free and valid for one year no access to the job market! Please ensure that your legitimation card has been given back before you receive your settlement permit Within two years you have to fulfill the integration contract modul 1 (A2 level). After two years of legal stay with settlement permit you get a three years extension if you have reached A2 level

Your spouse or civil partner / your children Holding a valid legitimation card, your spouse or civil partner and your minor children can apply for the same settlement permit as well Children over 18 may receive: residence permit „student“ (Aufenthaltsbewilligung - Studierender) settlement permit as a key personnel (Aufenthaltstitel Rot-Weiß-Rot-Karte) settlement permit „private“ – limited by quota (Niederlassungsbewilligung – privat, quotenpflichtig)

Daueraufenthalt-EG - the permanent status You may acquire the permanent status if you have been legally resident for 5 years in possession of sufficient means of subsistence and health insurance you have fulfilled B1 level free access to the job market in Austria!

For EU- and Swiss Citizens Have you just registered your address in Austria? (Meldezettel) Please apply for a document for EU-Citizens that certify your right of residence: „Anmeldebescheinigung“ or „Bescheinigung des Daueraufenthaltes“ Those persons whose address was already registered in Austria prior to 1.1.2006 the address registration (Meldezettel) is sufficient

In case you are married... Being married or having a civil partnership with an EU- or Swiss Citizen who also lives in Austria you can apply for long-term settlement permit „Aufenthaltskarte“ or „Daueraufenthaltskarte“ Being married or having a civil partnership with an Austrian you can apply for a residence titel „Familienangehöriger“ (A1 level) or „Daueraufenthalt- Familienangehöriger“ (B1 level)
