2 2 Land Use Plan Policy CO-12 Confined Horse Facilities Special Compliance Program  Eligible facilities: located on parcels larger than 15,000 square feet existed prior to 2001 and after the effective date of the Coastal Act does not have an open Coastal Commission violation case pending  Two year CDP application period  Two pathways toward compliance: 1)Full conformity with the LCP - the facility would be extended legal status 2)If it is not possible to bring the facility into full conformity with the LCP - the facility must comply with certain minimum requirements and may remain on a temporary basis

4 Open Coastal Commission Violation Case: A case regarding a structure, or facility, where, as of April 10, 2014, Coastal Commission staff had: (1) conducted an investigation; (2) on the basis of that investigation, determined that the allegations warranted creation of a violation file; and (3) created such a file and assigned the matter a violation file number.  Total of 24 pre-2001 open Coastal Commission violation cases for horse facilities in the Plan Area.  4 of these cases have been elevated to the Commission’s headquarters' enforcement unit for initiation of formal enforcement proceedings 4

5 5 Local Implementation Plan Section 22.44.690.Y Confined Horse Facilities Special Compliance Program  Eligible facilities would have 2 years from LCP certification to apply for a CDP, which may be extended for good cause.  Eligible facilities that are subject to an open Coastal Commission violation case would have 1 year to apply for a CDP, which may be extended for good cause.

6 6 Compliance Process – Phased Conformity (Legal Non-Conforming)  Maximum feasible buffer from any stream, riparian or wetland habitat - 25 feet minimum  Slopes of 3:1 or less steep  Best Management Practices (BMPs)  Protective fencing around native trees  Restoration of any portion(s) of the facility that must be removed  Mitigation for temporary impacts to H1 habitats  Recordation of a deed restriction  Requirements and conditions of the permit shall be fully accomplished within 2 years, except that all required BMPs shall be implemented within 1 year

7 7 Compliance Process – Phased Conformity (Legal Non-Conforming)  Permit valid for a period of 8 years. The permittee may apply for up two additional 8 year extensions for a maximum total of 24 years from the certification date of the LCP.  For properties sold during the life of a permit, the purchaser may apply to retain the horse facility for a term not to exceed the remaining term of the facility’s prior permit, plus an additional 8 year term. In no case shall the cumulative term of the new permit extend beyond 16 years from the date of certification of the LCP.  Temporal impacts to H-1 habitats shall mitigated at a 1:1 ratio within the first 8 year permit term.  The facility shall be removed and site fully restored at the end of the approved term of the permit.
