CONSTRUCTION OF 400kV TRANSMISSION LINES Medupi - Massa 1 and 2 (Duration 11 months) CLARIFICATION REQUEST FROM BIDDERS CLARIFICATION RESPONSE FROM THE EMPLOYER AFTER BID ISSUE 1 _The location of the revised / approved Construction Environmental Management Plan referred to in 1.20 of the EA 12/12/20/894. Please note this is not referring to the Final Construction Management Programme as this is a separate document. _The Site specific EMP referred to in the EA condition 1.20 is the same as the Final Construction Environmental Management Programme which is document number in Annexure E of the Works Information. Please note this is not referring to the Final Construction Management Programme as this is a separate document. 2 _It is noted that TRMSCAAC 1 Rev 3 is Superseded and replaced by TIEW REV 1. _Yes TRMSCAAC 1 Rev 3 is Superseded and replaced by TIEW REV 1 and is an Eskom Standard for the Construction of Overhead Powerlines. 3 _Please confirm that the Project Specification (U.TX /07/06/001 REV 2) takes precedence over TIEW REV 1 even though the latter was produced and published before the former. _The Project Specification (U.TX /07/06/001 REV 2) does not supersede TIEW REV 1, these are two separate documents. 2017/04/28

CONSTRUCTION OF 400kV TRANSMISSION LINES Medupi - Massa 1 and 2 (Duration 11 months) CLARIFICATION REQUEST FROM BIDDERS CLARIFICATION RESPONSE FROM THE EMPLOYER AFTER BID ISSUE 4 _We can specify/price for the use of 355JO steel as required by ESKOM, but cannot guarantee the availability of this material. What would be the course of action if the material is not available? As an alternative to the above, would ESKOM consider changing the specification to 355JR? _Eskom will consult with the steel manufacturers. For the bidding purpose the bidders will be required to provide prices for both S355JR and S355J0 separately and the BOQ will be amended to have a provision for this in both Schedule 1 and Schedule 2. If by the time of contract award there is no consensus reached, we will go with S355JR and specifically request for the Charpy test to be performed and the certificate submitted to Eskom. This clarification will be discussed in detail and dealt with in the clarification meeting. 2017/04/28

Contract condition for this contract: Procurement of Plant Design, Supply & Installation (FIDIC) Some of Eskom’s Particular Conditions (PC’s) in ‘our FIDIC’ included in the contract conditions. Important ones: Arbitration (foreign suppliers to choose which rule they want to apply); assignment, insurance, etc. Standard Forms that you have to complete (don’t improvise..!) and to submit e.g.Letter to Bid – name, bid price and discount. General Information Consider JV’s if you do not as a single entity meet the qualification criteria. JV requirements: i) Agreement “jointly and severally liable” ii) clearly state WHO has the authority to sign the bid and the contract by means of resolution or standard form Pre-bid meetings in future: Please attend. Important – Fraud and Corruption Clause (F&C)
Whenever Eskom makes use of Funding from the WB, the provision of the F&C clause WILL apply. (Already placed vs future contracts). Briefly: “Whenever the Employer determines that the Main Contractor and/or his Subcontractors …. has engaged in..Corrupt, Fraudulent, Collusive, Coercive or Obstructive Practices (definitions in clause), then notice will be given and the Contract may be terminated and the Contractor will be expelled from the Site”. Corrupt – giving, receiving, offering of anything of value to influence improperly the action of “others” (e.g Eskom employees, Bank employees, employees of any organisation taking or reviewing Procurement decisions) Fraudulent – act, omission, misrepresentation to obtain a benefit either financial or otherwise. 2017/04/28

F&C…. Collusive – arrangement between two or more parties designed to achieve an improper purpose…. Coercive – impairing or harming, threatening any party or property … Obstructive – deliberately destroying, falsifying .. evidence material to the investigation by the Bank or Eskom … and acts to materially impede the Bank’s inspection which this clause gives them. 2017/04/28

F&C continued… F&C clause is one of the most important clauses to Eskom and the WB! WHY? Consequences: WB loan to Eskom might be put in jeopardy and recalled Contractor and/or his Subcontractor may be debarred from future WB contracts and appear of the WB’s debarment list. Contract be terminated – loss of jobs, money etc. SA Reputational Damage AVOID THESE PRACTICES AT ALL COSTS ! 2017/04/28

In preparation for WB review: Put controls and mechanisms in place to ensure none of these actions are happening or if, they are picked up timeously. Evaluation Criteria SD&L amounts to 30% of the total tender evaluation points. Total of 10% for B-BBEE Total of 20% for Localization A minimum threshold of 60% must be achieved for SD&L.

Skills Development Skills development will form part of the localisation evaluation criteria. Tenderers will be required to propose Skills development initiatives in terms of skills required for a project. Skills will have an entry requirement and an exit qualification i.e. (Electrical artisan -N3 =Trade certificate - CETA accredited) The selection of the candidates to be developed will be based on the location of the site and the candidate’s location. Focus will be on youth from previously disadvantaged backgrounds.

Job Creation (Not a weighted Criteria)
Suppliers will be required to propose the number and type of jobs to be created as a result of a project. The requirements with regard to job creation will be as follows: Core team which will be made up of specialised skills should comprise of supplier’s in house staff. Semi skilled and unskilled labour that will be used in executing the works to the extent that is possible should be sourced from areas local to the site where the substation is located.

B-BBEE Requirements Eskom prefers doing business with level 1-4 B-BBEE compliant suppliers. Suppliers that fall outside this range will be required to migrate to level 1-4 within a period that will be agreed upon depending on the level where they are currently. Suppliers will be required to submit valid B-BBEE certificates from accredited verification agency. Companies with an annual turnover of less that R5 million will be required to submit a letter from auditors confirming the turnover and the status of the company.

Observations It was confirmed that no spreader bar is necessary for the safe lifting of the masts. The advantages that the tandem lift holds include: Detailed inspections can be conducted from ground level on all attachments. A stable, secure and safe lifting operation is possible using two cranes. Workers is sent up the mast only once, after mast guy ropes are securely attached and masts are stable, to unhook the cranes. Traditional two step operation is now combined into a one step operation with potential time savings. No special equipment or procedures are required.

Method statement erection of cross rope
Increasing safety of the cross rope includes: Stringing of the earth wire using a nylon pilot wire. Changing the stringing sequence so that the earth wire is strung, tensioned & regulated and clamped in before stringing of phase conductors commence. Using ladders that hang from the service rope to climb down onto the conductor bundle. Climbing down the insulator is not permitted.

Essential Safety And Health Requirements
The contractor must ensure that they comply to health & safety requirements by having a system in place that will monitor and evaluate effectiveness of all documentation in place. The following essential documentation must be submitted: Procedures/Method Statements – All procedures/MS must be signed and approved. Letter of Good Standing- Must be valid. Emergency Preparedness & Response Plan. Fall Protection Plan & Rescue Plan. Incident Management Management of Sub-contractors & Suppliers.
