5 www.ejtn.eu LESSONS LEARNED Main Challenges 1.Understanding the phenomenon of foreign terrorist fighters 2.The role of the judiciary in detecting and preventing radicalisation to violent extremism (risk assessment) 3.Cooperation at the domestic, supranational and international levels 4.Tangible data on rehabilitation/de-radicalisation programmes 5.Anticipatory criminalisation and fundamental rights 6.Gathering and admissibility of evidence 7.Time-management, language barriers and scarcity of resources

6 www.ejtn.eu LESSONS LEARNED Training Needs 1.Substantive law (new Directive on Combating Terrorism, CoE Additional Protocol to the Convention of the Prevention of Terrorism, national definitions of terrorist offences) 2.The gathering and admissibility of evidence (evidence gathered in conflict zones, evidence from social media, use of intelligence as evidence and investigation strategies) 3.Cooperation at the national level, cooperation at the EU level and with third countries (e.g., transit zones, US) 4.Sentencing and prison regimes (role in disengagement/de- radicalisation, sentencing of minors) 5.Judicial tools (database national legislation, case-law, terrorist organisations, etc.)
