1. Organic Fertilisers and Soil Improvers (OF/SI) Regulation (EC) 1069/2009 - Article 32 Implementing Regulation (EC) 142/2011 –Article 22 and annex XI

2. Definition of OF/SI Defined in 1069/2009 as: materials of animal origin used to maintain or improve plant nutrition and the physical and chemical properties and biological activities of soils, either separately or together

3. Definition of OF/SI Definition includes: compost and biogas digestate fertilisers from processed products or processed animal protein (PAP) products obtained from processing of hides ash from incinerators incinerating ABP milk and milk products, colostrum and colostrum products manure, digestive tract content and guano egg shells and shellfish shells

4. Categories of Animal By-Products Under 1069/2009 OF/SI can be derived from: Category 2 material (Article 13) Category 3 material (Article 14) Category 1 material cannot be used for OF/SI Ash effectively out of scope of Regulation

5. Collection and identification Must be accompanied during transport by commercial document Must list origin, destination and quantity of material, and a description Not required for movement of manure between farms Not required for retailers selling to final users

6. Labelling During transport and storage of OF/SI a label must be attached to the packaging, container or vehicle, which must: clearly indicate the Category of the derived product in the case of Category 3 material, state ‘not for human consumption’ in the case of derived products from category 2 material, state ‘not for animal consumption’

7. Labelling OF/SI must also be labelled ‘organic fertilisers and soil improvers/ no grazing of farmed animals or use of crops as herbage during at least 21 days following application’ Labelling requirements do not apply to unmixed bags of organic fertilisers in ready-to-sell packages of not more than 50 kg for use by final consumers in horticulture or gardening.

8. Record Keeping Operators consigning, transporting or receiving OF/SI must keep records for 2 years Not required for retail sales to final users

9. Approval and Registration Plants handling OF/SI need to be approved under art 24 or registered under art 23 Approval is required for: Processing (rendering) plants Plants manufacturing organic fertilisers from mixed materials including derived products e.g. sterilised poultry manure and seaweed Storage plants (except for on site application)

10. Approval and Registration Registration is required for: transporters of OFSI plants where only mixing takes place plants repackaging derived products for retail sale

11. Manure and Processed Manure Manure may be applied to land without processing where no risk of spreading disease Processed manure must be heat treated to 70C/60 mins or by an alternative method based on demonstration of suitable pathogen destruction

12. Conditions for Production Category 2 material intended for OF/SI must be: processed to method 1 (pressure sterilisation) marked with glyceroltriheptanoate (GTH) Exceptions for manure, digestive tract content, milk, colostrum, eggs and their products which can be used in composting or biogas production without prior processing Manure, digestive tract content, milk and milk products and colostrum can be applied direct to land

13. Conditions for Production Category 3 material intended for OF/SI must be: Processed to method 1-7 in approved plant sent for composting or biogas without processing milk, milk products and colostrum can go direct to land application For trimmings and splittings derived from limed hides must be subject to treatment which ensures no risks Hides past liming stage out of scope but competent authority may require limed hides and pickled pelts to be accompanied by commercial document when sent to plants for producing OF/SI

14. Mixing To minimise risk of use for feeding purposes, the following derived products must be mixed with a “component” prior to use: category 2 meat and bone meal processed animal proteins (category 3) does not apply to ready-to-sell bags of 50kg or less for use by final customers for horticultural or gardening purposes

15. Mixing(contd) Competent authorities in MSs are required to only authorise components which: Exclude subsequent use for feeding purposes by making the product ‘unpalatable’ to animals or otherwise be effective in preventing misuse of the mixture have been assessed in terms of climatic impact and effect on soil condition

16. Aim: Preferably find an unpalatable component – but this is difficult! Alternatively find a component, which is likely to discourage use – colour/ appearance/ type of material; Final product satisfies microbiological testing criteria. Mixing rules in UK

17. Conclusion: A number of trials done on possible components. Needed to find component : with particle size sufficiently large to be visible when incorporated into meat and bonemeal / processed animal protein but small enough to avoid issues with homogeneity Following met these criteria : Wood Shavings (>2%) Limestone Chips/ Grit/ Prills (>2%) Inorganic fertiliser prills (>2%) Mixing rules in UK (continued)

19. Sampling OF/SI containing PAP or derived products from category 2 or 3 material must be sampled during storage or on withdrawal from storage for Salmonella and Enterobacteriaceae In accordance with Regulation 882/2004 on official food and feed controls and ISO 17025 Salmonella and E. Coli for compost and biogas digestate

20. Grazing Ban Farmed animals must not have access to herbage from land either by direct access or by using cut herbage as feed for at least 21 days following application of OF/SI Does not apply to manure, digestive tract content, milk, milk products and colostrum, unless competent authority consider there to be a disease risk.

21. Grazing Ban The person responsible for land to which organic fertilisers have been applied and to which farmed animals have access must keep a record for at least 2 years of: quantities of organic fertiliser applied date and place of application date at which livestock were allowed back on to the land
