4 Ohio Aviation Association Airspace Zoning BACKGROUND  County Airport Program, c. 1970, made zoning a prerequisite for receiving a grant  ORC Chapter 4563 (Airspace Zoning) Most publicly owned airports have zoning Originally slightly different From FAA Part 77 Surfaces Airport Zoning Board (in most cases, the County Commissioners) Airspace Zoning Board of Appeals $100/day penalty

8 Ohio Aviation Association Airspace Zoning PROBLEMS WITH THE OLD AIRSPACE ZONING PROCESS  40+ years of turnover and retirement  Lack of administrative procedures  Lack of local knowledge  Agricultural exemptions  Did not conform with F.A.R. Part 77

9 Ohio Aviation Association Airspace Zoning RESULTS AND RESPONSE  Objects have been constructed that are obstructions, resulting in: Displaced runway thresholds (shortened runways) Extensive cost to remove obstructions Safety issues  Solution: Ohio Airport Protection Act (ORC Chapter 4561) Adopts FAR Part 77 dimensions for ODOT and for local zoning ODOT provides statewide review

11 Ohio Aviation Association Airspace Zoning CURRENT PROCESS - FAA  FAA Form 7460, “Notice of Proposed Construction or Alteration,” must be filed for any proposed object that penetrates the 100:1 slope from the runway  File online at: oeaaa.faa.gov  FAA cannot stop construction, but can require displaced threshold or relocated runways at the affected airport  ODOT must have access to Form 7460 information - a critical step in the process

12 Ohio Aviation Association Airspace Zoning CURRENT PROCESS - ODOT Ohio Airport Protection Act (ORC Chapter 4561):  ODOT must receive the Form 7460 information to determine whether a permit is needed  When filing the Form 7460 online, building proponents should print the completed form to a.pdf file and email it to John Milling: John.milling@dot.state.oh.us  A hard copy can also be sent to John at the Office of Aviation

13 Ohio Aviation Association Airspace Zoning CURRENT PROCESS – ODOT (cont.)  If necessary, ODOT works with proponent to modify location and/or height of the proposed construction  ORC 4561 also mandates that existing airport zoning boards adopt revisions so that local airspace zoning conforms with FAR Part 77

14 Ohio Aviation Association Airspace Zoning CURRENT PROCESS - LOCAL  Local Building and Zoning Departments should be aware of Part 77 Filing Criteria, and make sure that building proponents: Are also aware of the filing criteria File Form 7460 online when appropriate Email a copy to ODOT (John Milling)  Counties should update existing zoning to conform with Part 77  Counties should add administrative procedures to enforce existing zoning
