4 4 City of Coral Gables “Rewrite” of development codes City Commission has directed City Administration in 2004 to complete the evaluation/rewrite of the City development codes –Zoning Code –Comprehensive Land Use Plan

5 5 “Rewrite” of Zoning Code Planning and Zoning Board reviews completed: –Policy direction – Sept.- Dec. 2004 –Review/recommendation of Code since Dec. 2004 –Completion date of “Rewrite” – Dec. 2005

6 6 “Rewrite” of the Comprehensive Land Use Plan (CLUP) State of Florida requires the review of the CLUP every 5 years –“Evaluation and Appraisal Report (EAR) Assessment of CLUP and major issues Due to State in April 2006 Rather than “evaluate”, Staff is rewriting the CLUP –Rewrite of the CLUP is necessary to be consistent with Zoning Code Rewrite EAR will be provided to the Board and scheduled for review next month

7 7 CLUP Map and Zoning Map need to be consistent As a part of the Zoning Code rewrite process, Florida Statues require the correction of “inconsistent” zoning to comply with CLUP map designations Assigned CLUP map designation “governs” –Zoning needs to be changed to be consistent with the CLUP map

8 8 CLUP Map and Zoning Map need to be consistent City of Coral Gables CLUP, Objective 1- 1.3 and Policy 1-1.3.4 requires achieving compliance with the Future Land Use map and actual uses, and to examine and revise the Zoning Code to correct any inconsistencies

9 9 Changes to the CLUP map Changes to the CLUP Map that may be required either to correct existing graphic scrivener’s errors or changes Will be completed as a part of the CLUP rewrite EAR will be distributed next month

11 11 Change in Zoning Map will be completed in a 2 part process Part 1 – Identify/correct inconsistent existing Zoning Map classifications to be consistent with the CLUP Map classifications Part 2 – Recommend/adopt new Zoning classifications and map as a part of the Zoning Code rewrite

12 12 Part 1 – Identify/correct inconsistent existing Zoning Map classifications Examples of required changes – City Parks City parks and open space areas currently have either single family or commercial zoning –Approximately 22 locations were identified as inconsistent This request assigns all public and private recreational facilities as “S -Special Use zoning” to be consistent with the “Parks and Recreational Land Use classification”

13 13 Part 1 – Identify/correct inconsistent existing Zoning Map classifications Examples of required changes – City facilities City buildings and grounds currently have either single family, commercial or no assigned zoning This request assigns “S - Special Use Zoning” to be consistent with the “Public Buildings and Grounds Land Use Classification” –Approximately 5 locations were identified as inconsistent

16 16 Summary of inconsistent existing Zoning Map classifications 67 locations were found to have inconsistent zoning and CLUP map classifications (see Attachment A and B - “Inconsistent Property map and table) 67 locations identified as inconsistent include 163 separate properties (property owners) –48 locations are privately owned properties –19 locations are City of Coral Gables properties 3 parcels owned are existing improvements within the public right-of-way (green space, parking areas, etc), which previously had no assigned Zoning Map and/or CLUP Map classification.

36 36 Findings of fact The following “Findings of Fact” support approval of this request/recommendation: –The State of Florida Growth Management Act of 1985 mandates the City adopt a CLUP Future Land Use Map, and Florida law requires that the zoning designation of properties within the City be consistent with the Future Land Use Map. –Objective 1-1.3 and Policy 1-1.3.4 of the City’s CLUP requires achieving compliance with the CLUP Plan Future Land Use Map by reducing the number of inconsistencies between the future land Use Map and actual land uses, and to examine and revise the Zoning Code to correct any inconsistencies.

37 37 Findings of fact (continued) Criteria has been established to determine inconsistent properties that shall require a change of zoning or land use amendment to come into compliance, and land use and zoning categories for specific existing land uses. Forty-six (46) parcels have been identified that have inconsistent CLUP and zoning designations and require a change of zoning.

38 38 Findings of fact The City of Coral Gables is in the process of rewriting the Zoning Code, which has resulted in the creation of new zoning classifications, which are required to be reflected and shown on the City’s Zoning Map. The City has completed extensive outreach to property owners of the 67 parcels as well as Citywide to advise of the process and public hearings.

40 40 Staff Recommendation The Planning Department recommends the Planning and Zoning Board based upon the “Findings of Fact” contained herein recommends approval of the following: –Part 1: Recommendation and adoption of the Inconsistent Property Map Ordinance. Change of existing Zoning Map classifications on specific inconsistent properties to provide for the correct Zoning Map classification to be consistent with the current/correct Comprehensive Land Use Plan (CLUP) Map classification. –Part 2: Recommendation and adoption of the new Zoning Classifications and Map Ordinance per the Zoning Code rewrite.

42 42 Timeline for Change in Zoning Maps Review and consideration by the City Commission: –1 st Reading, Tuesday, September 27, 2005, 11:00 a.m. –Tentative 2 nd Reading, Tuesday, November 22, 2005, 11:00 a.m. (dates and times are subject to change)
