3 Advocacy vs. the Role of the Attorney Learning Targets: 1.I can define the term “advocacy” as it applies to the law. 2.I can define the 4 roles of the attorney in the legal process. 3

4 Advocacy Advocacy is the act or process of supporting a cause or proposal: the act or process of advocating something. NOTE: Anyone can be an advocate through the acts of: Protest Lobbying Voting Working with Special Interest Groups to change or create laws. But, Lawyers are more than just Advocates… 4

5 American Bar Association Model Rules of Professional Conduct PREAMBLE: A LAWYER'S RESPONSIBILITIES [1] A lawyer, as a member of the legal profession, is a representative of clients, an officer of the legal system and a public citizen having special responsibility for the quality of justice. [2] As a representative of clients, a lawyer performs various functions. As advisor, a lawyer provides a client with an informed understanding of the client's legal rights and obligations and explains their practical implications. As advocate, a lawyer zealously asserts the client's position under the rules of the adversary system. As negotiator, a lawyer seeks a result advantageous to the client but consistent with requirements of honest dealings with others. 6 So, Advocacy is just PART of what lawyers do. Lawyers are: Advisors - Help clients figure out what to do. Advocate - zealously asserts the client's position Negotiator – seeks advantage for client honestly without violating the law Evaluator – keeps clients apprised of what is going on (even when not specifically asked to do so) Know these roles. 6

7 Activity – Practicing Advocacy Problem 3.4, page 37 – “Law Around the World – The Screening Law” Form groups of 2-3, Read the Fact Pattern. A.Briefly discuss Part A of the problem. Decide which if any of the people should be permitted to serve in the new government. B.After you have decided which, if any, of these people should be allowed to serve in the new government you WILL formulate one or more arguments in favor of including and excluding each of these people from the new government. C.Your team will then be asked to present your arguments for one of the 5 individuals. I will call on you randomly. You will not know which side you will be arguing until you are called on. Be prepared to defend your positions either way. D.You have 20 minutes to prepare for the hearing. 7
