4 th Amendment The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Judges Decision Is… They agreed in favor with the… School District

School District Case All students participating in competitive extracurricular activities should be drug tested. Known as “Student Activities Drug Testing Policy”

Earls Case Lindsey Earls & Daniel James argument to the court was this new drug testing policy violated their Fourth Amendment Rights. In addition the policy did not address a proven drug problem in the school.
