What is a Copyright? Copyright is: “The legal right granted to an author, a composer, a playwright, a publisher, or a distributor to exclusive publication, production, sale, or distribution of a literary, musical, dramatic, or artistic work.” Only the owner has the right to choose where and how their work is used. What is Fair Use? Fair Use guidelines apply when copyrighted works are used for scholarship, classroom instruction, or research. In such cases permission does not have to be obtained. Fair-use was created to make it easier for students and educators to use copyrighted materials for educational purposes. Information taken from Education World Series.Education World Series.

When Does Fair Use Apply? Four factors that help determine what can be used under fair-use guidelines. –Works must be used for educational purposes that are non-profit –The amount of the source that is used does matter –The type of source being used (music, poetry, photographs, etc.) makes a difference. –The material can not divert money from the creator Information taken from Education World Series.Education World Series.

How Much is too Much? There are specific portion sizes that teachers and students must adhere to: –As a general rule no more than 10% of the work may be used. –There are more specific portion limits for different types of material, for example less than 250 words can be used of a poem, or a maximum of 30 seconds of a song can be used in a presentation. Copy Limits Under Fair Use? No more than two copies can be in use at the same time. This allows for one copy to be used in a classroom and another to be placed on reserve in the library. Additional copies can be made for portfolio purposes and for each group member working on a project. Teachers may keep a copy of a presentation for two years before needing to request permission.
