People with disabilities in the labor market Eurostat: 80 million people with disabilities in Europe Employment rate: 68% of non-disabled people 20% people with disabilities More than three million People with disabilities are working in sheltered workshops. A clear legal framework is needed, that permits people with disability to get employed with the necessary protection, and - if it should become necessary - to come back again in day care

Fight against social exclusion The year 2010 was declared as year of „Fight against social Exclusion „ by the European Union. So the Austrian Federal Government decided to take appropriate measures in their government program. The aim is to give "equitable and sustainable“ access to legally social secured employment, and examine the possibilities of implementing independent social insurance coverage of people in sheltered areas. That means, contracts of employment with all the rights, obligations and wages are one way to prevent poverty and social exclusion of people with disabilities.

The Austrian Situation  Distinction by ASVG into two categories: “fit for work" or “not able to work” The level for the assignment of performance of 50% is arbitrarily chosen. This assignment is also basis for the division of responsibilities between federal and state governments  “Benefit trap” Risk to loose benefits

UN Convention on the Rights of Persons with Disabilities Article 27 – Work and emloyment "States Parties recognize the right of persons with disabilities to work, on an equal basis with others; this includes the right to the opportunity to gain a living by work freely chosen or accepted in a labour market and work environment that is open, inclusive and accessible to persons with disabilities. States Parties shall safeguard and promote the realization of the right to work, including for those who acquire a disability during the course of employment, by taking appropriate steps, including through legislation."

Results and demands 1 Inclusion, starting with birth, in all areas of life has to be secured by appropriate conditions such as assistance and services. Legal rules that describe people with disabilities as “incapable“ have to be removed. Discrimination because of disability in all aspects of labor and employment has to be excluded by law from all EU Member States Equal opportunities in employment and occupation have to be guaranteed. This right also includes appropriate support by the federal and state governments..

Results and demands 2 People with disabilities should enjoy their full labor rights and trade union rights as everybody else. It is necessary to provide structures and professional education and training opportunities in order to initiate the necessary developments. General and special programs have to be developed and offered. Creaming effects have to be avoided. There have to be possibilities to start companies and enterprises, and cooperatives to establish their own business should be developed.

Results and demands 3 People with disabilities have to be employed in public administration appropriately. Therefore it is necessary to adjust the framework. Also the private sector has to offer such conditions for people with disabilities. This requires additional financial subsidies and adjusted compensation taxes. Professional and achievable options for rehabilitation have to be provided for people with disabilities. There has to be the possibility of changing between employment and working in a protected system, without loosing transfer payments to avoid the “benefit trap”.
