Human Trafficking Human Trafficking is an organized crime which violates all tenets of human dignity and rights Trafficking can occur for various purposes--labour, commercial sexual exploitation, organ trade, slavery etc. Poverty, illiteracy, lack of livelihood options, natural or man made disasters makes a person vulnerable to trafficking India faces in-country and cross border trafficking

National Legal Framework Criminal Law (Amendment) Act, 2013. Immoral Traffic (Prevention) Act, 1956. Indian Penal Code (select provisions). Child Labour (Prohibition and Regulation) Act 1986. Juvenile Justice (Care & Protection of Children) Act, 2000 & Amendment Act 2011 Prohibition of Child Marriage Act, 2006 and POCSO 2012.

International Conventions India ratified the United Nations Convention on Transnational Organised Crime (UNCTOC) Protocol on Prevention, Suppression and Punishment of Trafficking in Persons, particularly women and Children. Human trafficking has specifically been defined (S 370 A) through , “Criminal Law Amendment Act, 2013” India has ratified the SAARC Convention on Preventing and Combating Trafficking in Women and Children for Prostitution. A Regional Task Force was constituted to implement the SAARC Convention on Preventing and Combating Trafficking in Women and for prostitution.

Bilateral Mechanism An MoU with Bangladesh on prevention of trafficking signed in June 2015 A Task Force of India and Bangladesh has met Five times so far- the last in Aug 15. Similar MoUs planned with other countries Negotiations with UAE likely to take place soon

Key Initiatives so far Supporting states setting up AHTUs (225/270/330) Capacity Building of AHTUs Judicial Colloquiums Certificate Course by IGNOU in Human Trafficking Regular meeting with State Nodal officers Regular data collection by NCRB

Key Initiatives so far … A web portal on Human Trafficking Compendium of advisories Advisory to border states and BSF/SSB to be involved in district crime meetings Operation Smile/ Muskaan Good results

Priority areas of action Revamping AHTU scheme To cover all remaining districts Set up IUCAW and linking with AHTUs to increase investigative capacity in districts/ states Strengthen Operation Muskaan and decide way forward Incentive to active AHTUs National Coordinating Body Effective coordination among different stakeholders at National State and district level Unified data base interlinked with CCTNS/Track Child /Talaash Including trafficking victims in victim compensation scheme of states Strengthen the bilateral mechanism with Bangladesh

Priority areas of action … Evolve a bilateral mechanism with neighbouring countries Sri Lanka, Nepal, Myanmar and Afghanistan Improvement of repatriation mechanism with Bangladesh and Nepal and other neighbouring countries. Forms of reporting the cases of Human Trafficking be standardized. Revamping of web portal and linkage with Nirbhaya Portal Learning Management System and self assessment module in this portal Developing a network of active NGOs to assist Law Enforcement Agencies

Priority areas of action … There should be One stop crisis centers. Standard of care to the victim be formulated. Continuous training should be given to the officers handling the cases at ground/lowest levels. Protocol to deal with rescued foreign nationals whose identity establishment is difficult Awareness campaigns can be started by adding one chapter in school curriculum and by organizing camps and Nukkad Nataks at village levels. Helpline 1098 to be advertised widely till 112 is made functional
