Governmental Advisory Committee Public Safety Working Group 1

History Our members have advocated to: 2 Create consumer safeguards for new gTLDs Improve contract provisions in Registrar Accreditation Agreement and Registry Agreement Improve WHOIS accuracy

Recent Work 3  Found on GAC website: Public+Safety+Working+Group Public+Safety+Working+Group  Website also includes our GAC representatives, Working Group members and PSWG comments

Recent Work 4 Comments on:  2013 RAA WHOIS Accuracy Specification Review  Privacy Proxy Accreditation Issues  Next Generation WHOIS

Recent Work 5 Comments on:  2013 RAA WHOIS Accuracy Specification Review o Reinforced need for verification (accuracy) and validation (proper format) of WHOIS data o In response to Registrar proposals: Sought justification for Registrar proposals to increase time from days if no response to requests for verification (and signaled drawbacks to such an extension) Sought clarification of certain terms (“substantial” “substantiated”) [note context: failure to respond to Registrar inquiry re: inaccurate WHOIS information]  Privacy Proxy Accreditation Issues  Next Generation WHOIS

Recent Work 6 Comments on:  2013 RAA WHOIS Accuracy Specification Review  Privacy Proxy Accreditation Issues/ Advocated for: o Distinction between Commercial and Non-Commercial Users o More transparency and accountability for PP Service Providers o Confidentiality of law enforcement requests (as required and/or permitted by local law)  Next Generation WHOIS

Recent Work 7 Comments on:  2013 RAA WHOIS Accuracy Specification Review  Privacy Proxy Accreditation Issues  Next Generation WHOIS o Recognizes complexity of creating a new system and calls for improved accuracy o Signals need to balance public interest in creating a safe and reliable environment, including preventing and fighting crimes on the internet and ensuring respect and enforcement of consumer rights with securing the protection of personal data of Internet users. o Advocates for consulting with variety of public stakeholders such as law enforcement, consumer protection and data protection authorities

Recent Work 8 PSWG joins Registry Agreement Specification 11 Security Framework Drafting Team (voluntary standards) GAC advised that Registry Operators should conduct “Security checks” —to assess whether domains in its gTLD are being used to perpetrate security threats (e.g., pharming, phishing, malware, and botnets Registry Agreement: Specification 11 (Public Interest Commitments) ¶ 3 (a) and (b) requiring security checks. Spec. 11 does NOT include details about how to implement such security checks. ICANN solicits community participation to develop a framework for “Registry Operators to respond to identified security risks that pose an actual risk of harm (…)”. Consults with GAC and Registries.

Future Work Upcoming new gTLD review on Competition, Consumer Choice and Consumer Trust WHOIS accuracy for IP addresses More participation in existing ICANN working groups Outreach to:  other government partners  other ICANN stakeholders 9
