2 PUBLIC SAFETY WORKING GROUP (PSWG) – UPDATE TO THE GAC Agenda Item 7 | ICANN 56 | 28 June 2016

3 | 3 The specificity of the PSWG within the GAC  A unique forum comprised of experts largely from law enforcement and consumer protection agencies.  A resource for the GAC to draw on - proposes advice to the GAC based also on real, operational, considerations.  Important to understand that PSWG members have been active at ICANN for a decade, previously separate from GAC.  We are still learning to work well together.  Building up processes and optimal communications.  Increased formalization since early 2015:  PSWG created as GAC WG at ICANN 52 Singapore, February 2015.  Terms of Reference endorsed by GAC at ICANN 53, June 2015.  Work plan endorsed by the GAC, January 2016.

4 | 4 The PSWG needs your help  The PSWG needs your help to encourage participation in the PSWG, in particular from:  Data protection representatives: as security and privacy are inter- related.  Developing country representatives: critical for public authorities of all countries, including developing countries, to understand and participate in public safety efforts relating to the DNS.  More outreach and co-operation needed, including joint outreach efforts with the GAC Working Group on Under-served Regions.  More information: https://gacweb.icann.org/x/z4FhAg.https://gacweb.icann.org/x/z4FhAg

5 | 5 GAC PSWG: our achievements  The PSWG has been very active since its creation, in particular providing input on key WHOIS-related tracks.  We categorize the main themes of our work as: 1. Outreach and meetings 2. WHOIS, both DNS and IP 3. Cybersecurity, consumer protection, other public safety topics  Some of our recent focus areas:  March 2016 workshop with NRO/ASO on IP WHOIS  GAC comments on PDP WG NGRDS (WHOIS replacement)  WHOIS privacy and proxy services (PPSAI)

6 | 6  ‘Guide to ICANN for Law Enforcement’: general information on ICANN, the GAC, the PSWG and background on some of the PSWG’s focus areas – newcomers.  Other outreach and liaison actions highlighted in program of work, including with the GAC Working Group on Human Rights and International Law (WGHRIL);  Capacity building: Ongoing, co-organized recent webinars in collaboration with ICANN Security, Stability and Resiliency team and GAC under-served Regions working group. 1. PSWG processes, meetings and outreach

7 | 7  WHOIS case studies: illustrate real use of DNS and IP WHOIS databases in criminal investigations.  PDP on Next Generation Registration Data Services (NG RDS): PSWG liaison. GAC comments. This PDP is just beginning substantive work.  IP WHOIS accuracy: continuing collective dialogue with Regional Internet Registries (RIRs) towards better IP WHOIS accuracy, following joint workshop at ICANN55 in Marakech.  PDP on Privacy and Proxy Services Accreditation Issues (PPSAI) report: separate session. 2. WHOIS, both DNS and IP

Cybersecurity, consumer protection, other  Registry Agreement Security Framework (Spec 11):  providing input on a framework of voluntary best practices for registry operators to check and respond to security threats.  “Healthy Domains Initiative” (HDI) separate, private sector initiative by DNA.  New gTLD Competition, Consumer Choice and Consumer Trust Review : GAC Chair’s representative on CCT RT from PSWG. Priorities are Cat 1 safeguards for sectors with clear/regulated entry requirements and PIC effectiveness.  2013 Registrar Accreditation Agreement - follow-up previous GAC advice  Implementation of cross-validation in the RAA (contractual obligation).  Status update on how registrars are accredited in view of the GAC’s LEA recommendation from 2011 (part 2).  GAC Beijing advice for malware statistics: on phishing, botnets, pharming, malware, from registries and registrars or ICANN’s security department.  Other issues on DNS abuse reporting and contract compliance.
