Presentation transcript:

The 1 st Amendment “5 “N-word” went to 4 real quick, gang banging 4 “N- word” still hanging”.

Is that language ok? Is it protected under the 1 st amendment? Ok for everyone? Age inappropriate? What do you think?

Snyder v. Phelps PBL Case example one On one side is Albert Snyder, the father of a Marine who was killed in Iraq. funeral was picketed by the anti- gay fundamentalist Westboro Baptist Church. On the other side is Fred Phelps, the Westboro pastor who seeks national publicity for his opposition to gay rights.

major test of speech rights vs. safeguards for the sanctity of military funerals. Snyder won a $5 million verdict against Phelps and his followers for his distress, but a federal appeals court overturned it on First Amendment grounds

PBL Case example two Board of Educ. v. Pico, 457 U.S. 853 (1982) Concerning the removal of books deemed to be anti-American, anti- Christian, and anti-Semitic, from public high school and junior high school libraries.

Local school boards may not remove books from school libraries simply because they dislike the ideas contained in those books and seek by their removal to "prescribe what shall be orthodox in politics, nationalism, religion, or other matters of opinion Students do not "shed their constitutional rights to freedom of speech or expression at the schoolhouse gate”

PBL Case example three United States v. Eichman, 496 U.S. 310 (1990) Concerning burning of the United States flag.

While flag desecration is deeply offensive to many, the Government may not prohibit the expression of an idea simply because society finds the idea itself offensive or disagreeable

PBL Case example four Hazelwood School Dist. v. Kuhlmeier, 484 U.S. 260 (1988) Hazelwood School Dist. v. Kuhlmeier, 484 U.S. 260 (1988) Concerning censorship of a high school newspaper

Respondents, former high school students who were staff members of the school's newspaper, filed suit against the school district and school officials, saying their First Amendment rights were violated by the deletion from a certain issue of the paper of two pages that included an article describing school students' experiences with pregnancy and another article discussing the impact of divorce on students at the school

The school principal acted reasonably in this case in requiring the deletion of the pregnancy article, the divorce article, and the other articles that were to appear on the same pages of the newspaper

PBL Case example five Lamb's Chapel v. Center Moriches Union Free School District, 508 U.S. 384 (1993) Concerning the use of public school property for religious meetings

New York law authorizes local school boards to adopt reasonable regulations permitting the after- hours use of school property for 10 specified purposes, not including meetings for religious purposes. Pursuant to this law, respondent school board issued rules and regulations allowing, social, civic, and recreational uses of its schools but prohibiting use by any group for religious purposes.

RELIGION OK AFTER HOURS  Appellate Court upheld school  Supreme Court REVERSED!
