Intake If someone discloses misconduct to you… Staff and faculty (except those designated as a confidential resource) who become aware of sexual misconduct or harassment are required to report such information to a Title IX Official. We know that conversations surrounding sexual misconduct and harassment are sensitive in nature. We recommend you use the BHSU Title IX Intake Form which was created to support faculty and staff responding to disclosures.BHSU Title IX Intake Form

Initial Report Immediately report all matters of sexual misconduct to a BHSU Title IX Official Filed directly with a Title IX Official from the reporting party Intake information forwarded to the Title IX Official from any responsible employee State law requires notification to law enforcement of any felony acts.

Title IX Interview Title IX Administrator meets with reporting party to discuss reporting options. Interim measures and referrals to support services offered. Title IX Administrator determines if a Title IX investigation is warranted Several factors considered here…if the reporting party does not want the University to investigate, this will be balanced with community safety.

Title IX Investigation An investigation will be completed by a specially trained Title IX Investigator. The investigator will conduct the initial interview with the reporting party. If necessary, witness interviews and follow up interviews are conducted. During this process, updates are provided to all parties by the Title IX Coordinator. The reporting party and responding party may receive interim measures and referrals to support services.

Finding of Fact The Title IX Investigator will make a finding of fact. The finding of fact is determined using the preponderance of evidence standard (more likely than not)

Final Report Findings are shared with VPSLE (if responding party is a student) or HR (if responding party is an employee) to determine next action. Title IX Administrator also provides written notification to both parties. Both parties review final report at the time they are informed of the finding of fact and sanctions/job action (if applicable).
