1 Complainant files complaint in person or through online reporting system to one of the entities defined by an arrow Bemidji State University & Northwest Technical College Discrimination/Harassment Complaint Process Typically 60 days are allowed for investigation completion Decisionmaker* determines whether policy violation occurred Complainant, Respondent, & Designated Officer notified. Supervisor & HR OR Dean of Students contacted for remaining concerns Campus administrator or supervisor receives complaint No policy violation exists Designated Officer* receives complaint & conducts preliminary investigation. Goal is to make the offensive behavior stop. Decisionmaker notifies Complainant, Respondent and Designated Officer. Sanction is implemented. Policy violation exits Appears to be a Disc/Harass issue Reasonable cause exists Does not appear to be a Disc/Harass issue Comprehensive investigation occurs & report written Matter is referred to an appropriate campus resource No basis to proceed exists Decisionmaker collaborates with Dean of Students for student respondent or supervisor & HR for employee respondent to determine sanction. Case closed. Des. Off. notifies Complainant and Respondent Either party may appeal to President within 10 days to based on factors such as procedural error, new evidence or severity of sanction. Investigator notifies other party. President makes decision and notifies complainant, respondent & Designated Officer. Informal Resolution: Designated Officer intervenes to stop offensive behavior. Meets with complainant and respondent Informs parties of process & options Offers options for informal/developmental resolution. Informal resolution successful & documented in writing & signed by both parties. Informal Resolution Unsuccessful *Designated Officer: Title IX Coordinator – Debra Peterson, Deputy 315, ; *Decisionmakers: Deans, Vice Presidents or Designees
