Update on the process for development IPPC legislation adopted by the Peoples Assembly of the RS in december 2004, four Laws on: – Environmental Protection; – Environmental Impact Assessment; – Strategic Environment Impact Assessment – Integrated Pollution Prevention and Control Enacted on bases of the Project “Jugolex” ( )

Project “Yugolex” “Development of Environmental Legislation in RS” Agreement concluded between Finnish Government and FRY Government 2002 Financed by Finnish Government Covers Serbia and Montenegro/ three years ( ) The aim of the Project: –Approximation to EU legislation

Operator obligations and responsibilities Apply for permit/ reconsideration of issued permit Act in compliance with conditions set by the permit Submit results to the competent authority Inform the competent authority about all changes in operation, namely functioning of installation or an accident Submit to the competent authority the annual report on execution of the activities Inform the competent authority on planned change of operator

Project “Yugolex” “Development of Environmental Legislation in RS” Phase II of Project: I. Capacity Building Programme II. Development of BAT Guidance (in preparatory phase) III. Support from financial and other institutions for further implementation of IPPC

I. Capacity Building Programme Capacity building for the environmental administration (state and local level) is a priority area. – An ambitions CB program, comprising environmental administration of the Republic of Serbia, the Authonomous Province of Vojvodina and almoust 40 municipalities has been realized – May in Novi Sad The CBP was designed on the pilot case scheme.

Public environmental administration staff –Ministry of Science and Environmental Protection, Directorate for Environmental Protection (DEP) –Provincial Secretariat for Environmental Protection and Sustainable Development –Municipalities & cities

I. Capacity Building Programme 2. Business sector Companies was selected on the basis of: –Expressed interest for the Project implementation –Prospect of Chambers of Commerce –Joint understanding of DEP and Provincial Secretariat for Environmental Protection and Sustainable Development, respective chambers of commerce and companies itself 3.NGOs –Out of the Project scope –Particularly desirable –Several representatives

The first National BERCEN training- Minimum criteria…. in the Republic of Serbia on three levels (republic, autonomous and municipal) work about 200 inspectors, it is necessary to train all inspectors according to the program of First national BERCEN seminar. –On the First national BERCEN seminar there were 33 participants present – 18 republic inspectors from Serbia and Montenegro, employees from other sectors of the Ministry for the Protection of Natural Resources and Environment and 6 inspectors from Autonomous province of Vojvodina.

The first National BERCEN training- Minimum criteria…. 1.Recommendation of participants is to start the implementation of PROPOSAL OF EUROPEAN PARLIAMENT AND COUNCIL OF EUROPE – Minimal requests for inspection control of environmental protection in the regular work of republic inspection. The basis will be the check lists prepared for inspection oversight in Thermal-electric Plant Obrenovac, inspection oversight in the field and prepared reports on First national BERCEN seminar.

Development of BAT Guidance Pilot-projects in different kind of industries to know-how to make the platform for definition BAT standard Obligation of state to supply actual data and information about development of BAT in the world, for 31 kind of industrial activities In the process of translation BAT standard documents

III. Support from financial and other institutions for further implementation of IPPC These items are not included in the Project –Detail list of the industrial enterprises supported to IPPC –Costs for the enterprises in compliance with the request of the IPPC regulations –Development of program saving energy and resources in each enterprises –Costs for waste management in installations –Costs for administration on the Republic level, Autonomous Province and municipalities

Problems and Obstacles Decentralization will slow implementation process Municipalities are entitled to issue IPPC permits Republic level administration is responsible only for capital investment Capacity building – lack of number and educated stuff (Permiters do not have technical education or background) Isolation period – Out-dated or partly out-dated technology in existing IPPC installations Tremendous needs of investment in BAT Not enough accreditation laboratories for measuring emissions the lack of resources for translation and adoption into Serbian of BAT documents limited capacity and resources for participation of industry experts, state institutions in development of BAT documents
