Better Regulation for Better Results Presentation to the Social partners 15 July 2015

What is Better Regulation? Legislation/policy making that delivers objectives at least cost and burden A method - common sense way of working throughout the policy cycle to foster: o high-quality initiatives that are evidence-based; with no unnecessary burdens for business/public authorities o transparent participation of all stakeholders; o initatives that actually deliver as foreseen and remain fit for purpose. Not about weakening social or environmental standards or replacing political decisions.

Main elements of the BR Package Greater transparency - More extensive feedback/public consultation - Improved explanatory memorandum Better Tools - Integrated Better Regulation Guideline + Toolbox - Interinstitutional agreement on better regulation Focus on implementation - REFIT : integral part of the CWP; New Platform; - Stronger role for evaluation.

Listening – Responding: New REFIT Stakeholder Platform 2 groups (FVP/Chair of RSB): o Stakeholders/COR/EESC o Member States Web interface: "Lighten the Load – Have your say…." Commission (SG with DGs) will have to ensure follow-up to the Platform's ideas. REFIT is a systematic part of the CWP

A Shared Commitment - IIA on Better Regulation -Programming (annual/multiannual) -Impact Assessment -Monitoring/evaluation (in each new act) -Priority Setting (Fast-tracking proposals) -Legal drafting/recast -Delegated/Implementing Acts

Social Partner agreements A standalone guidance tool on the better regulation requirements to guide services in the area of social partner agreements; Role/autonomy of social partners fully respected; The Commission cannot change the text of the agreement but ….. Commission must decide whether to propose Union legislation or not.

Social Partner agreements (2) Commission undertakes proportionate assessment where expected impacts are significant. Focus: representativeness of the signatories, legal compatibility with Union law; and the respect of the principles of subsidiarity and proportionality; Social partners invited to make the text of their agreements publicly available and to provide any useful elements for the Commission's assessment; No additional public consultation is foreseen. The Treaty role of the social partners will be respected.
