December ‘12: WTO-appointed arbitrator gives U.S. 10 months to meet WTO obligations March ‘12: U.S. files appeal against WTO ruling November ‘11: WTO panel releases final report. Finds U.S. COOL discriminates September ‘08: U.S. implements COOL legislation via interim regulations

October ‘13: Ag Minister Gerry Ritz threatens trade retaliation September ‘13: Tyson Foods stops buying slaughtered Canadian cattle, citing high costs of COOL April ‘13: Canada states proposed rules are unacceptable March ‘13: USDA issues proposed rules to modify COOL

COOL IS HEATING UP…… - U.S. Court of Appeals in Washington threw out a previous ruling by a three judge panel that ruled against our legal challenge. - In a very rare legal moment, all 11 judges on the court will now reconsider the basis of our argument on the constitutional question of corporate free speech.

- Counsel representing the plaintiffs (CPC and the Canadian Cattlemen’s Association being two of the nine) are working with clients on amicus (‘friends of the court’) briefs to support our own briefs. - Briefs should be in before the end of April and oral arguments will be presented May 19. The court has not indicated a date at which a decision would be issued. - A very long process. Very good support by the Feds.

CETA - Comprehensive Economic & Trade Agreement. - European market is 33 times larger than Canada's. - Our current quota is 6000 tonnes. The quota increase is approx. 80,000 tonnes. - Said to be worth $400 million annually to our industry.

Trade Negotions and Trade Access Continue to work with: Canada Pork International Canadian Meat Council Canadian Agri-Food Trade Alliance, including the Canadian Cattlemen’s Association

Pork Research, Market Development and Promotion Agency Industry consultation started. Agency to support domestic product promotion, export development and research. Non-refundable levy of $0.75 per hog could generate additional $1.8 million on imports. Needs letter of support from each provincial pork board in Canada.
