EPA’s Proposed CCB Regulations & Morgantown STAR Project 2 Current CCB Regulations –Federal (EPA): Exempt from RCRA Subtitle C Categorized as "special waste" –State (MDE): Disposal / Mine Reclamation: Transportation / Beneficial Use (Proposed)

EPA’s Proposed CCB Regulations & Morgantown STAR Project 3 EPA’s Proposed Coal Combustion Residual (CCR) Rule –Published: June 21, 2010 in Federal Register –Public Comment Period: Open until November 19, 2010 –Final Rule Timeline: Not yet established –Beneficial uses of CCRs in encapsulated form (concrete, wallboard, etc.) are encouraged and exempted –Three regulatory options proposed: Subtitle C – Hazardous Waste Subtitle D – Non-hazardous Waste Subtitle D’
