Article II- The Executive Branch

A. The President is not directly elected by the citizens, but by the Electoral College B. The Founders wanted the President to be strong enough to fulfill his responsibilities, but not able to overpower the other branches and endanger people’s rights C. Congress was given a check for most of the listed powers in Article II:

1. Appointments- The President can select Supreme Court justices, cabinet members and ambassadors, but the Senate must approve 2. Treaties: The President may write a treaty, but the Senate approves or rejects 3. War: The President is Commander in Chief of the armed forces, but only Congress can declare war 4. Veto: The President can veto laws, but Congress may override with a 2/3 majority

D. Impeachment- President on trial 1. The House of Representatives must first decide if there is enough proof to accuse the President of crime 2. If the House decides a crime has been committed the President is tried by the Senate 3. The trial is presided over by the Chief Justice of the Supreme Court 4. If the President is found guilty, he is removed from office
