Maryland Work Permit Process The Maryland Employment of Minors law is designed to encourage the development of minors by allowing them to engage in occupations that prepare them for responsible citizenship, yet protect them from occupations that will be injurious to their mental, moral, or physical welfare. The Division of Labor and Industry is responsible for the enforcement of the Employment of Minors law. The Issuing Officer is responsible to verify compliance with the Employment of Minors law before issuing a work permit.

Maryland Work Permit Process Before an Issuing Officer can verify compliance with the Employment of Minors law the minor who is seeking to obtain a work permit must complete the following. Instructions for the Minor Step 1 – Print a hard copy of the work permit application which can be downloaded from the Department’s website at http://www.dllr.state.md.us/labor/empm.shtml. Complete the minor’s information section. It is important that the minor also sign and date the application. Step 2 – Take the application to the employer to complete the employer’s section. Step 3 – Have the parent or guardian review, sign and date the application.

Maryland Work Permit Process Step 4 – Using the completed hard copy of the application the minor should log back on to the website, complete the online application, save the information and print the data receipt. When the minor has completed their part of the work permit process, they should then take the completed hard copy of the application, the data receipt, and proof of age such as a birth certificate, valid driver’s license/permit, state identification card, passport or any other valid government issued document that provides the date of birth to the issuing officer.

Maryland Work Permit Process Using the information provided by the minor, the issuing officer is now able to verify that the employment is allowed by law and issue the work permit to be forwarded to the employer. Instructions for the Issuing Officer The Issuing Officer should follow the following steps: Step 1 – Log on to the Minor Work Permit web site: http://www.dllr.state.md.us/labor/empm.shtml and enter the receipt number to retrieve the online application. Review the hard copy of the application to ensure that it contains all the required signatures then verify that the online data and the information noted on the application are the same.

Maryland Work Permit Process Step 2 - Based on the documentation provided, verify the age of the minor. A minor under the age of 14 may not be employed or permitted to work.* Minors 14 through 17 years of age may only work with a work permit. This permit must be in the employer’s possession before the minor is permitted to work. * Minors under the age of 14 can be employed as a model, performer or entertainer with a special permit issued only by the Commissioner of Labor and Industry. Certain activities are not considered employment for purposes of the Employment of Minors Law provided the activity does not involve mining, manufacturing or hazardous occupations and it takes place outside of the school day. The Employment of Minors Fact Sheet which can be downloaded from the Department’s website at http://www.dllr.state.md.us/labor/minorfactsheet.doc provides a complete list of these activities as well as the occupations which are considered hazardous for minors 14 through 17 years of age.

Maryland Work Permit Process Step 3 – Verify the work duties of the minor. To ensure the safety of Maryland’s working youth, certain occupations are declared hazardous by the U.S. Secretary of Labor and have been adopted by the Commissioner of Labor and Industry for the State of Maryland. (See the Employment of Minors Fact Sheet for a complete list of these occupations.) Step 4 - Approve the permit. After the minor’s age has been verified and a review of the work duties indicate that the employment is allowed by law, the issuing officer is now ready to approve the permit. At the bottom of the online application check off the following items: ● Has the application been signed by the minor, parent and employer? ● Is the minor between the ages of 14 – 17? ● Select the Proof of Age and verify that the online application matches the hard copy application. ● Click the approve button to print the Maryland Work Permit for Minors. ● Sign the official Minor Work Permit and give it to the minor to provide to the employer. ● Retain the hard copy of the application on file for three years.

Maryland Work Permit Process This concludes the Minor Work Permit Issuing Officer Training.
