TIMELINE FOR ADOPTION OF POLICY Timeframe Actions Taken December 3, 2004 IDEA signed into law April 2005 WVDE issued IDEA 2004 Interim Guidance Document July 1, 2005 IDEA 2004 went into effect August 2005 Policy 2419 development began October 13, 2006 IDEA 2004 regulations in effect November 9, 2006 State Board approved Policy for comment November-January 2007 Eight regional public hearings were conducted; Policy available for public comment February 2007 Additional dialogue with stakeholders March 21, 2007 WVDE conference with WVASA conducted April 12, 2007 State Board approved and adopted Policy 2419 May 16, 2007 Policy 2419 in effect

West Virginia Department of Education Chapter 1-FAPE p. 4 Section 2. FAPE Considerations, C. Public Insurance Funds To access a student’s public insurance (e.g., Medicaid reimbursement), documentation of adult/student consent which specifies the records to be disclosed, the services to be provided, and the duration of the services must be obtained. Therefore, to meet the consent requirement, each district must obtain consent at the initial IEP Team meeting and at each annual review (i.e., at least once a year). The district must also obtain parent/adult student consent if billable services (i.e., type, amount and/or duration) are revised at anytime during the time frame of the IEP. The parents must be informed that their refusal to consent to the release of information does not relieve the district of its responsibility to ensure that all services are provided at no cost to the parents. Additional Evaluations If the EC or IEP Team determines that a comprehensive multidisciplinary evaluation is required to determine whether a student meets the criteria for a different exceptionality, the district must conduct the evaluation within 80 days of the documented date of receipt. Additional Evaluations In those instances when an additional evaluation completed by an outside agency has not been completed within 60 days, the district is required to document its reasonable efforts to obtain the additional evaluation within 60 days. In this situation, when a district has documented its reasonable efforts to obtain the evaluation within sixty days, the district is not considered to be in violation of the sixty day timeline.
