UK Approach to Transposition The Guiding Principles for EU legislation

UK Government Commitments Coalition Programme for Government –w e will end the so-called gold-plating of EU rules, so that British businesses are not disadvantaged relative to their European competitors Guiding Principles for EU legislation –published in December 2010 –Completed July 2011 – include operating principles for Early Engagement and Influencing Transposition Guidance –revised and published April 2011

UK Governments Approach The Government's approach is: –to look at the cumulative impact of new EU measures. –wherever possible, argue for alternatives to regulation at European level –to engage with the European Commission before it has adopted proposals to increase UK influence –to build alliances with other MSs, MEPs and other EU- level stakeholders to increase the UKs effectiveness in negotiation

From Negotiation to Transposition The Principles establishes how policy makers and Ministers tackle the flow of EU legislation. Introduction of a new step requiring Cabinet Committee scrutiny and clearance –Before starting transposition, departments must satisfy the Reducing Regulation Committee (RRC) that they have identified the aims of the EU law and the relevant policies of the UK Government, and how the two will be brought into harmony so that transposition neither has unintended consequences in the UK nor risks infraction. –The UKs independent Regulatory Policy Committee must clear impact assessments for all transposition proposals. –The European Affairs Committee should be kept informed.

Approach to Transposition When reviewing departments' approach to transposing and implementing EU law, the RRC will expect departments to apply the following principles: –within two weeks of publication in the OJEU, the RRC to have been notified and provided with a pro forma including an outline project plan to the obligations coming into force; –proposed implementation applies the Guiding Principles and meets the standards in the Government's guide to European policy-making; –proposed implementation complements domestic legislative objectives; and –proposed implementation delivers the outcomes required by the directive and is supported by evidence showing it will minimise the cost to business.

Policy Development Stages Prior to consulting on options for transposition, and prior to finalising domestic measures that implement EU obnligations, Ministers must seek RRC clearance When transposing EU law, the Government will: –wherever possible, seek to implement EU policy and legal obligations through the use of alternatives to regulation; –endeavour to ensure that UK businesses are not put at a competitive disadvantage compared with their European counterparts; –always use copy out for transposition where it is available, except where doing so would adversely affect UK interests e.g. by putting UK businesses at a competitive disadvantage compared with their European counterparts. If departments do not use copy out, they will need to explain to the RRC the reasons for their choice; –ensure the necessary implementing measures come into force on (rather than before) the transposition deadline specified in a directive, unless there are compelling reasons for earlier implementation; and –include a statutory duty for Ministerial review every five years.

What does this mean Departments Linking more closely those that negotiate with those that implement Strong emphasis on closer Ministerial involvement Strong emphasis on earlier planning and robust programme management –Ensure time to seek clearance / react to scrutiny (from RRC including RPC) –mitigate last minute problems –avoiding infractions: proactive management Guiding Principles do not just apply to Directives –Other types of EU legislation may be captured by the Guiding Principles
