Oxon Run and C&O Canal TMDLs March 8, 2004

Overview In settlement of the TMDL lawsuit in the District of Columbia, EPA has agreed to back stop TMDLs for waters included on the District's 1998 Section 303(d) list of impaired waters. To fulfill the consent decree requirements, EPA and the District to are sharing the TMDL development workload. EPA must approve or establish TMDLs for the Chesapeake and Ohio Canal and Oxon Run by December 15, 2004, in order to satisfy the requirements of the lawsuit.

Overview The District's 2002 Section 303(d) list of impaired waters identified the pollutant of concern as follows: Metals and bacteria as Oxon Run's pollutants of concern, and Bacteria and organics as the Chesapeake and Ohio Canal's pollutants of concern. The Consent Decree identifies "metals" as the substances identified in Table 2 of Section 1104.7 of the District's water quality standards, and, "organics" as the substances identified in Table 3 of Section 1104.7 of the District's water quality standards at 21 D.C.M.R. Chapter 11.

Schedule Sources assessment and the technical approach needs to be completed by June 1, 2004. Draft TMDL report submitted to Region 3 and DOH for internal review & comment by August 1, 2004. Revised draft TMDL to the Region and DOH (incorporating the comments) by September 1, 2004. Final TMDL report submitted to EPA by November 15, 2004. Final TMDL report must be approved by EPA by December 15, 2004.
