doc.: IEEE Submission July 2007 John Notor, Cadence Design Systems, Inc.Slide 2 Background FCC summary of action taken and further notice of rulemaking in the proceeding In the Matter of Modification of Parts 2 and 15 of the Commissions Rules for unlicensed devices and equipment approval: –Specifically, we dismiss a petition for reconsideration filed by Warren C. Havens and Telesaurus Holdings GB LLC (Havens) requesting that the Commission suspend the rule changes adopted for unlicensed devices in the MHz (915 MHz) band until such time as we complete a formal inquiry with regard to the potential effect of such changes to Location and Monitoring Service (LMS) licensees in the band. –We also dismiss a petition for reconsideration filed by Cellnet Technology (Cellnet) requesting that the Commission adopt spectrum sharing requirements in the unlicensed bands, e.g., a spectrum etiquette, particularly in the 915 MHz band. –We are, however, seeking comment on its recommendations for a spectrum etiquette in a Further Notice of Proposed Rule Making (Further NPRM) in this proceeding. Specifically, the Further NPRM seeks comment on a specific spectrum etiquette for unlicensed transmitters that operate under Sections and of the rules in the 915 MHz band.

doc.: IEEE Submission July 2007 John Notor, Cadence Design Systems, Inc.Slide 3 Comments Requested in FNPRM The FCC is specifically requesting comments on the following: –Should the FCC require spectrum etiquette for future devices operating under Part , and devices operating under Part , in the 915 MHz band? –Should the FCC implement spectrum etiquette proposed by Cellnet in the rules? –Should some etiquette other than that proposed by Cellnet be adopted? –Should the etiquette apply to all Part and Part frequency bands? Frequency bands affected: – MHz (915 MHz band) – MHz (2.4 GHz band) –5725 – 5850 MHz (5.8 GHz band) IEEE 802 Standards potentially affected: – – – (unlicensed operation)

doc.: IEEE Submission July 2007 John Notor, Cadence Design Systems, Inc.Slide Action Plan will take up formal consideration of comments to the FCC reqarding this FNPRM at the September 2007 Interim Meeting is soliciting the views of affected wireless groups regarding proposed changes in the ISM band rules relating to spectrum etiquette plans to submit formal Comments to the FCC after the September 2007 interim plans to submit Reply Comments to the FCC, if necessary, after reviewing the Comments submitted to this proceeding.
