The Lisbon System for the Notification and Registration of Appellations of Origin

Substantive Requirements (1) Protection in the country of origin Ex ante recognition “Appellation of origin” as defined in Lisbon “Country of origin” as defined in Lisbon Demarcation of the area of production

Substantive Requirements (2) Entitlement to file applications –The competent authority of the country of origin –Registration shall be effected in the name of those having, under their national legislation, a right to use the appellation

Formal Requirements Official form Fees: 500 Sfr (registration) 200 Sfr (modification) Language: E, F or S Translation and transliteration Correction of irregularities Certificate Notifications to 3rd countries Publication

Legal Effect (1) Effect of international registration –extension of protection to countries other than the country of origin –indefinite (as long as the appellation is protected in the country of origin) Except in a country that... –issued a refusal (within the prescribed time-limit), or –invalidated the effect of the international registration in its territory

Grounds of refusal As available at the domestic level

Legal Effect (2) Required level of protection (at a minimum) –protection against any usurpation or imitation –cannot be deemed to have become generic Standing for taking legal action
