Cyberlaw The Birth of the Internet _______________________________________________ US Dept of Defense in the late 1960’s The Advanced Research Projects Agency tied together computers from universities and the DOD into a network called ARPANET In the late 1980’s the National Science Foundation (NSF) built its own network. This more advanced network took over from the DOD and was called the __________ After 20 years of academic and scientific use, the internet was opened up to almost anyone through the and the use of a very simple hypertext language called World Wide Web Hypertext Markup Language or HTML Internet

Cyberlaw This man was credited with writing the language of the Internet – HTML- but never profited from opening up the Internet to everyone. Others, however, have profited immensely from the internet. Tim Berners-Lee worked at the European Laboratory of Particle Physics

Cyberlaw jurisdiction State courts have jurisdiction over their citizens. Federal courts have jurisdiction over cases involving citizens of different states, federal questions, and cases involving large amounts of money. The question becomes, whether the case should be tried in a court within the state where the case was filed… or where the E-commerce business is physically located.

Cyberlaw jurisdiction Two vital issues: 1. Whether the state in which the case is filed allows suits to be filed by non- residents (“long-arm statutes”) 2. Whether or not allowing the state or federal court to decide the case would be a violation of the Constitution’s due process laws.
