The FTC Do Not Call Registry Training TELEMARKETING TRAINING PROGRAM What is the National Do No Call Registry? It is a list of phone numbers from consumers who have indicated their preference to limit the telemarketing calls they receive. The registry is managed by the FTC, the nation’s consumer protection agency. It will be enforced by the FTC, the FCC, and state officials.  The do not call provisions of the TSR cover any plan, program or campaign to sell goods or services through interstate phone calls. This includes calls by telemarketers who solicit consumers, often on behalf of third party sellers. It also includes sellers who are paid to provide, offer to provide, or arrange to provide goods or services to consumers.

The FTC Do Not Call Registry Training TELEMARKETING TRAINING PROGRAM The do not call provisions do not cover calls from: Political organizations Charities Telephone Surveyors Companies a consumer has an existing business relationship For a consumer whose name is on the registry: A company may call up to 18 months after your last purchase, delivery or payment UNLESS the consumer asks not to be called. If a company then calls again, they could be fined up to $11,000.

The FTC Do Not Call Registry Training TELEMARKETING TRAINING PROGRAM If you make an enquiry or submit an application to a company: The company can call for 3 months UNLESS you ask not to be called. If your name is NOT on the Do Not Call Registry you can ask to be put on a company’s own do not call list.

The FTC Do Not Call Registry Training TELEMARKETING TRAINING PROGRAM THE REGISTRY The registry may not be used for any purpose other than preventing telemarketing calls to the telephone numbers on the registry. Any entity that accesses the national registry will be required to certify, under penalty of law, that it is accessing the registry solely to comply with the TSR or to prevent calls to numbers on the registry. The registry has been enforced since October 1, 2003. You can access the data as often as you like during an annual period for those area codes you have paid for. You may download data files from the registry once in an 24-hour period. The only consumer information you will receive is the registrants’ telephone numbers, sorted by area code. Access to the registry is restricted to companies that have paid a fee. You can access the registry via telephone or on the internet at www.telemarketing.donotcall.gov

The FTC Do Not Call Registry Training TELEMARKETING TRAINING PROGRAM COMPLIANCE It is against the law to call a number on the registry (Unless the company has a business relationship with that person.) Companies have to pay an annual fee to access the area codes to which they have subscribed. Telemarketers must make sure their seller-clients have paid for access to the registry before making any telemarketing calls on their behalf. The TSR has a “safe-harbor” for inadvertent mistakes. To meet the safe-harbor requirements, the seller or telemarketer must demonstrate the following

To meet the safe-harbor requirements, the seller or telemarketer must demonstrate the following It has written procedures to comply with the do not call requirements. It trains its personnel in those procedures. It monitors and enforces compliance with these procedures. It maintains a company-specific list of telephone numbers that it may not call. It accesses the national registry no more than three months before calling any consumer, and maintains records documenting this process. Any call made in violation of the do not call rules was the result of an error.

The FTC Do Not Call Registry Training TELEMARKETING TRAINING PROGRAM Before placing a telephone call to a non-exempt consumer, you MUST follow the requirements on the “Procedure” form. The Web site at www.telemarketing.donotcall.gov will have help available online during regular business hours via a secure electronic form. The best source of information about complying with the do not call provisions of the TSR is the FTC’s Web site at www.ftc.gov/donotcall. It includes business information about the registry. You can view the entire TSR at that site.
