Transform, Innovate, Lead Overview The Post 9/11 GI Bill (Chapter 33) is an educational assistance program enacted by Congress for individuals who served on qualifying Title 10 or Title 32 service on or after September 11, 2001 Chapter 33 GI Bill became effective: 1 August 2009

Transform, Innovate, Lead Veterans Education Assistance Act of 2008 Identified Active Duty as full-time duty in the regular components of the Armed Forces or under call or order to Active Duty under 10 U.S.C 688, 12301(a), 12301(d), 12301(g), 12302, or Active Duty definition at the time specifically excluded Full-Time National Guard Duty performed under Title 32 U.S.C. orders.

Transform, Innovate, Lead Veterans Education Assistance Improvements Act 2010 Expanded definition of active duty to include service in National Guard for certain purposes to include Full-time service– In the National Guard of a State for the purpose of organizing, administering, recruiting, instructing, or training the National Guard; or In the National Guard under section 502(f) of title 32 when authorized by the President or the Secretary of Defense for the purpose of responding to a national emergency declared by the President and supported by Federal funds.

ACTIVE GUARD AND RESERVE DUTY: GOVERNOR’S AUTHORITY (a)Authority.— The Governor of a State or the Commonwealth of Puerto Rico, Guam, or the Virgin Islands, or the commanding general of the District of Columbia National Guard, as the case may be, with the consent of the Secretary concerned, may order a member of the National Guard to perform Active Guard and Reserve duty, as defined by section 101 (d)(6) of title 10, pursuant to section 502 (f) of this title.101 (d)(6)10502(f)

Transform, Innovate, Lead TITLE 10, SECTION 101 (d)(6) (A) The term “Active Guard and Reserve duty” means active duty performed by a member of a reserve component of the Army, Navy, Air Force, or Marine Corps, or Full-Time National Guard Duty performed by a member of the National Guard pursuant to an order to Full-Time National Guard Duty, for a period of 180 consecutive days or more for the purpose of organizing, administering, recruiting, instructing, or training the reserve components.

Transform, Innovate, Lead TITLE 10, SECTION 101 (19) “Full-Time National Guard Duty” means training or other duty, other than inactive duty, performed by a member of the Army National Guard of the United States or the Air National Guard of the United States in the member’s status as a member of the National Guard of a State or territory, the Commonwealth of Puerto Rico, or the District of Columbia under section 316, 502, 503, 504, or 505 of this title for which the member is entitled to pay from the United States or for which the member has waived pay from the United States (FTNGD includes Title 32 AGR, ADOS, ADSW categories of service)

Transform, Innovate, Lead TITLE 32 CATEGORIES OF SERVICE Full-Time National Guard Duty Title 32 Section 316, 502, 503, 504, or (Title 32 AGR, ADOS, ADSW)

Transform, Innovate, Lead Title 32 ADOS/ADSW Full-time National Guard Duty (FTNGD)- Active Duty Operational Support (ADOS) or Active Duty Special Work (ADSW) - Is an authorized voluntary tour of FTNGD pursuant to Title 32 USC 502 (f)(2). - Its purpose is to provide the necessary skilled manpower assets to support existing or emerging requirements. - National Guardsmen from all 54 states and territories serve under this category of service everyday. (Not necessarily Post 911 GI Bill qualifying service)

Transform, Innovate, Lead OPERATION NOBLE EAGLE Currently, there is only one period of Title 32 ADOS or ADSW 502 (f) service that meets the requirement of the definition from the previous slide which was : "502(f) of Title 32 when authorized by the President or the Secretary of Defense for the purpose of responding to a national emergency declared by the President and supported by Federal funds.“ Operation Noble Eagle was authorized by the President under Proclamation 7463 which authorized the call-up National Guardsmen for airport security following the attack on the World Trade center. "Operation Noble Eagle from 11 Sep May 2002"
