RMS Meeting March 20, 2013 What Is Different About the EFL This Year? Where will find the Renewable Content Calculator _EFL Workbook this year? ERCOT.com The new location of the Renewable Content Calculator_EFL Workbook is on ERCOT.com/mktinfo/retail/electric web page. Previously it was on the TexasRenewables.com website There will be market notices announcing that the workbook has been placed on the website on April 1, Previous year workbooks are archived. 2

RMS Meeting March 20, 2013 Key Dates in the Process Generation Data Collection Data Collection for Electricity Facts Label Workbook process began in January, 2013 Deadline for submission of data is March 15, Renewable Content Calculator_EFL Workbook Per the Rule, the workbook will be posted on April 1, 2013 for Retailers to use. Competitive Retailers who use the PUC PowerToChoose.com website are required to complete a workbook for each of their products and this is to be done by July 1, ERCOT will send a market notice to the All Retail Electric Providers when the Workbook has been posted to ERCOT.com on April 1, A reminder notice to complete the EFL will be sent by ERCOT in June, 2013.

Substantive Rule Subchapter R. Customer Protection Rules for Retail Electric Service (h) Annual update. Each REP shall update its EFL for each of its currently offered products or products offered during the preceding calendar year no later than July 1 of each year, so that the EFL displays the renewable energy percentages determined pursuant to this section and reported to the registration agent for that product for generation purchased during the preceding calendar year. (i) Compliance and enforcement. –(1) Upon request from the commission staff, a REP shall provide a detailed explanation or accounting of the means by which it has authenticated any renewable or “green” energy claims in an EFL or any information used for marketing a product. –(2) The commission shall coordinate its enforcement efforts regarding the prosecution of fraudulent, misleading, deceptive, and anticompetitive business practices with the Office of the Attorney General, Consumer Protection Division in order to ensure consistent treatment of specific alleged violations.

RMS Meeting March 20, 2013 PUC Substantive Rule Sub Chapter R. Customer Protection Rules for Retail Electric Service (g) Electricity Facts Label. The EFL shall be unique for each product offered and shall include the information required in this subsection. Nothing in this subsection precludes a REP from charging a price that is less than its EFL would otherwise provide. –(1) Identity and contact information. The REP’s certified name and business name (dba) (if applicable), mailing address, and Internet address (if applicable), certification number, and a toll-free telephone number (with hours of operation and time-zone reference). –(2) Pricing disclosures. Pricing information shall be disclosed by a REP in an EFL. The EFL shall state specifically whether the product is a fixed rate, variable price or indexed product.
