2 The NYS Experience Moving Toward Evidence-Based Practices

Evolution of Risk/ and Needs Assessments  Increasingly popular in the field of corrections  Supported by the “What Works” literature  Guides case management and supervision practices

The Evolution of Risk and Needs Assessment Advantages Guides application of the principles of effective intervention Guides the intensity of supervision and case planning Ensures that appropriate criminogenic targets are identified for intervention

Advantages  Noted increases in predictive accuracy  Promotes a common theoretical model  Assists in the identification of factors correlated with future criminal behavior  Guides the development of a case management plan

Advantages  Guides the identification and effective use of resources  Guides the assignment of levels of supervision and service  Increases staff proficiency  Increases assessment and interview skill

COMPAS  Validated on New York Probation sample  Normed for incarceration status and gender  Three Risk Scales  Needs Scales: 3 historical; 16 criminogenic needs scales  Mental Health Screening and Referral  Ad Hoc Reporting Correctional Offender Management Profiling for Alternative Sanctions - Continued

COMPAS  Implemented in NYS for OPCA  Used in every stage of probation work Pre-Trial Pre-Sentence Investigation Classification and Supervision Case Planning Reclassification Correctional Offender Management Profiling for Alternative Sanctions

Risk and Need Assessment in Proposed Supervision Rule “The term risk and need assessment means the use of a state approved, validated actuarial instrument and recommended protocol to screen and assess the probationer’s risk of recidivism.” 11

Risk and Need Assessment in Proposed Supervision Rule Cont. Must be Completed Within 30 Business Days of Initial Interview (If Not Already Completed at PSI Stage), –Develop a Case Plan Using Evidence Based Practices, –Determine Risk Level, –In-Person Weekly Contact Until Assessment Completed and Risk Level Determined. 12

Risk and Need Assessment in Proposed Supervision Rule Cont. Encourages Departments to Allocate Resources Based on Risk Level –Greatest Risk –High Risk –Medium Risk –Low Risk 13

Benefits of Completing Assessment at PSI Stage Informs Recommendations to Court including Alternate Sentencing Options, Identifies Areas of Risk and Need appropriate for Monitoring and Intervention, Minimize Recommended Conditions on Lowest Risk Cases. 14

Periodic Reassessments- Case Reviews (Adult Cases) To be completed every six months for active criminal court and family court adult supervision cases, To be completed every 12 months for administrative cases (probationers who are otherwise unavailable for active supervision). 15
