The new Special Educational Needs Code of Practice EPIC Meeting

What is the Special Education Needs Code of Practice?  It is a guide for local areas, schools, pre-schools, and other professionals It tells them what the law says about education for children and young people with special educational needs (SEN) It was last updated in 2001 The current Code of Practice covers education for children and young people with SEN in school The new Code of Practice will cover education and support for young people from 0-25 years, so this will include information for colleges as well as schools

What does the Code of Practice do? This is known as ‘Primary Legislation’ It sets out the law For example ‘Disabled young people will have the right to apply for a Personal Budget’ Children and Families Bill Tells local areas what they must do to carry out the law For example ‘Local Areas must look at all applications for Personal Budgets within 6 months’ Regulations This tells professionals what they must do to make sure they work within the law For example ‘You must involve disabled young people in deciding how they get their Personal Budget’ Code of Practice

What is in the Code of Practice? Information in the Old Code of Practice The definitions of special educational needs How parents and professionals should work together Pupil Participation School action & school action plus – this is help in schools for young people with SEN How schools can identify and support children and young people with SEN Assessments Statements Annual Reviews Information in the new code of practice The definitions of special educational needs Legal responsibilities for schools, colleges and local areas How local areas and health services plan services together The Single Category (School Action & School Action Plus combined) The Local Offer Personal Budgets Education, Health and Care Plans Assessments

What is the timetable for the Code? September January 2013 Meet with groups who are interested in the Code of Practice New Year 2013 DfE start writing the first draft of the Code of Practice Spring 2013 DfE to publish a draft of the Code of Practice for Parliament to look at Autumn 2013 Public can comment on the draft Code of Practice Spring 2014 Final Code of Practice published *Timetable may be subject to change
