1 APCO FCC Guidance to the TA Establish a relocation schedule by NPSPAC Region Prioritize Regions based on population and interference Schedule adjoining Regions simultaneously as may be appropriate Complete Reconfiguration on a defined schedule 18-month, 20-Region benchmark: Complete Non-Nextel, Non-Southern LINC Channel relocation, initiate NPSPAC negotiations All Regions must start within 30 months of Start Date All Regions must be complete within 36 months of Start Date Recommend a Start Date for Reconfiguration

2 APCO Prioritization Plan Goals Follow FCC guidance as closely as possible, consistent with the overall goals of Reconfiguration Consider the needs and experiences of stakeholders Meeting the public interest needs of stakeholders 800 MHz band a complex, interrelated environment spanning Regions Reconfiguration must not disrupt mission critical systems Minimize number of touches to equipment in the field Factor international border constraints into the solution Timetable recognizes the challenge of international border negotiations Balance work load across Regions Availability of human and equipment resources Capabilities of key equipment manufacturers and product cycles Cost-effectiveness

3 APCO Prioritization Plan Process – Outreach Conduct licensee and association outreach Press releases requesting input, survey by mail, manufacturer meetings Meetings with licensees and associations that requested discussions Received 50+ comments, 145+ entities in 35+ Regions Met with 20+ licensees, associations, and manufacturers Outreach effort provided vital input to the Plan Key Regions need to reconfigure together Seasonal weather/work cycles require an extended retuning period Impact of international border agreements on achieving schedules Additional reports of interference to Public Safety systems Timing of procurement/contracting in Public Safety and CII organizations Availability of equipment and firmware/software required for retuning

4 APCO Prioritization Plan Process – Data Analysis and Clustering Analyze multiple datasets Five million licensee records from FCC ULS database Merge interference reports from APCO and Nextel Add PSR Region, international border, demographic data Create specialized query and mapping tools Research public record in FCC Docket No Identify Regional clusters Interconnectedness of Regions determined via outreach comments Licensed entities, base station density along and across Region boundaries

5 APCO Prioritization Plan Four Waves of NPSPAC Regions Overlapping mandatory negotiation and reconfiguration periods within each Wave band gets minimum 9 mo. retuning, NPSPAC gets minimum 15 mo. NPSPAC negotiations in each Region start as soon as sufficiently complete TA envisions additional FCC Public Notices announcing the start of each NPSPAC period Special process for large systems in more than one wave Multi-Wave entities begin Reconfiguration with the 1 st Wave in which they have systems Encouraged to start with the 1 st Wave even if they have no systems in that Wave

7 APCO Key Clustering Decisions Clustering NY Metro Region 8 NY Metro Region 8 must move with the Boston to DC corridor Cluster or interlocked regions are delayed Region 8 could also be clustered with Regions 30 (Eastern Upstate NY) and 55 (Western Upstate NY). However, border issues for Regions 30 and 55 would delay reconfiguration of high population/interference area along eastern seaboard Border constraints limit options for other Clusters California (Regions 5, 6) and Pennsylvania (Regions 28, 36) state-wide systems will be addressed individually Splitting Region 54 (Chicago Metro) at the Michigan border seems the most effective solution for the highly-integrated Extended Chicago cluster Oregon (Region 35) is a high-interference Region that should be addressed early. Vancouver, WA will be coordinated from rest of Washington Region (Region 43) if necessary Clustering Missouri (24) and Illinois (13) Extended Chicago Cluster should move in the 1st Wave due to interference and population Kansas and Missouri must move together but workload of 1st Wave deemed excessive East St. Louis area reconfigured separately from Region 13 to move with St. Louis, MO

8 APCO Timing of Prioritization Waves Notes:1. PN Window is period during which Public Notices announce start of NPSPAC Region negotiations 2. Multi-Wave entities will typically start Reconfiguration during the 1 st Wave in which they have systems

10 APCO Reconfiguration Start Date Definition of Reconfiguration Start Date: Official date when voluntary negotiations must begin between Nextel and licensees for the first Wave of Regions Reconfiguration cost estimates can also be submitted by licensees prior to this date under certain circumstances Start Date for the 1 st Wave of Regions is planned for 06/27/2005

11 APCO Key Prerequisites/Assumptions for Reconfiguration Start Nextel acceptance of the R&O FCC approval of the Prioritization Plan No material changes to the process result from Reconsiderations to the R&O / Supplemental Order EA and other elections completed Any Reconfiguration-specific FCC licensing processes ready Nextel selects Trustee & executes Tri-Party Agreement Nextel & TA implement processes to support Reconfiguration & associated funding Nextel & TA staffed and ready to support Reconfiguration start Licensee education: Develop training materials on Reconfiguration and funding process & conduct training Frequency assignments for 1 st wave of licensees ready by 6/1/2005
