IP: Intellectual Property – “creations of the mind: inventions, literary and artistic works, and symbols, names, images, and designs used in commerce” 2 Types of IP – Industrial Property e.g. invention, trademarks, industrial designs… – Copyrights artistic work, articles, novels, photography… 4 types of IP Protection – Patents – Trademarks – Trade Secrets – Copyrights

Patents ◦ Mainly for invention/manufacturing ◦ “The legal right to exclude anyone else from manufacturing or marketing it.” ◦ It lasts 20 years Trademarks ◦ word, name, symbol or device which is used in association with services or products ◦ It lasts 10 years

Trade Secrets – Information (a formula, pattern, device or compilation of data) that companies keep secret to give them an advantage over their competitors – E.g. Coca-cola – May lasts forever Copyrights – “Copyright laws protect written or artistic expressions fixed in a tangible medium - novels, poems, songs or movies.” – Protects the expression of idea, not the idea itself. – lasts for the life of the author + 50 years

 Your IP can:  Set your business apart from competitors  Be sold or licensed  Provide customers with something different  Be an essential part in branding your company  Once secured you can:  Make it your sole right to use, make, sell or import the product  Earn royalties by licensing it  Exploit it by establishing strategic alliances  Make money by selling it

1. File for protection. 2. Invest in legal counsel. 3. Arm yourself with knowledge. 4. Be realistic. 5. Respect the work of others. 6. Present a complete picture. 7. Give yourself a competitive advantage. 8. Use nondisclosure agreements. 9. Rely on legal protection. 10. Be patient.

 Issues from the Thomas case reading How do you value IP? Liable for anywhere from $18,000 to $3.6 m for 24 songs. How do you protect yourself from being sued, or infringing on rights?

 Can you be too aggressive in protecting your IP?  Are RIAA’s tactics effective or damaging, scary or justified?  How aware are you of what is IP and what is not?  Should entities like RIAA be allowed to enforce their copyrights at the expense of personal privacy (i.e. bulk subpoenas)?
