Employees Labour Law grants certain minimum standards such as: Social Security Insurance Pension Protection against dismissal

Independent Contractors No such minimum standards

Main issue in connection with gig economy Problem of 'false' self-employment Companies hire «independent contractors» who legally would qualify as employees Evation of the minimum standards as guaranteed by labour law

Uber Taxi case(s) in Switzerland Uber works with «independent contractors» No known court decisions regarding Uber Supreme court has decided that taxi drivers who work for taxi offices are not independet contractors but employees State Secretariat for Economic Affairs and Social Insurances qualify Uber as employer and its drivers as employees
