Miranda v. Arizona 5th Amendment Esther Ibarra and Cameron Bravo

What is the 5th Amendment? "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

How does this relate to the 5h amendment? Miranda was interrogated by police officers and detectives in a room where he was cut off from the outside world. He was not told what his rights were before he was interrogated, which was not to make any self incriminating statements. When a person's 5th Amendment Rights are not told to them, all statements are assumed to be involuntary, and cannot be used against a person in a criminal case. Miranda confessed to his crime, and was sentenced 20-30 years, even though he was not told his 5th amendment rights.

What the court ruled The Supreme Court ruled 5-4 in favor of Miranda. The police must ensure that defendants are aware of their rights before they are interrogated in custody They have to right to remain silent Anything they say may be used against them in court They have the right to an attorney
