The latest rendition of the Elementary Secondary Education Act (ESEA), the Every Student Succeeds Act (ESSA) was signed into law by President Obama in December of 2015. New legislation takes full effect in the 2017-2018 school year. The new law – “Every Student Succeeds Act” – corrects the erosion of NCLB and improves the services for nonpublic school children. New provisions increase and improve federally supported comprehensive educational services for nonpublic school students and teachers.

Ombudsman To help ensure that private school children, teachers and other educational personnel receive services equitable to those in public schools, State Educational Agencies (SEAs) must designate an ombudsman to monitor and enforce Title I and Title VIII equitable services requirements.

Title 1, Part A Purpose: Change: To provide all children significant opportunity to receive a fair, equitable, and high-quality education, and to close educational achievement gaps. Change: Each district must do this in accord with an equitable-share formula for funding that does not permit the district to set aside certain expenditures for other purposes. This includes all reservations previously taken “off the top” for administration, parental involvement, and district wide initiatives.

Title II-A Purpose: Increase student achievement Improve teacher, principal, and other leader quality and effectiveness Increase the number of teachers, principals, and other school leaders who are effective Provide low-income and minority students greater access to effective teachers, principals, and other school leaders

Change: A public school district must set aside a proportionate share of federal funds for the professional development of nonpublic school teachers. This “set-aside” on the part of the public school district – must now be based on the public school district’s total Title II-A allocation.

Title IV, Part A Student Support and Academic Enrichment Purpose: Well Rounded Education Safe and Healthy Students Effective Use of Technology (Title IV is currently unfunded.)

Title IV, Part B 21st Century Community Learning Centers Purpose: Provide opportunities for communities to establish or expand activities in community learning centers that: Provide opportunities for academic enrichment to help students particularly students who attend low-performing schools, to meet challenging State academic standards; Offers students a broad array of additional services, programs and activities to reinforce and complement the regular academic program of participating students; Offer families of students served by community learning centers opportunities for active and meaningful engagement in their children’s education

Timely and Meaningful Consultation The goal of consultation is agreement between the LEA and appropriate private school officials on how to provide equitable and effective programs for eligible private school children.

Timely and Meaningful Consultation Topics Should Include: How the proportionate share of funds is determined; Whether services will be provided directly or through a separate government agency, consortium, entity, or third-party contractor; Whether to pool funds for equitable services; When, including the approximate time of day, services will be provided;

Timely and Meaningful Consultation Whether to consolidate Title I equitable services funds with funds available for services to private school children under other ESEA programs Written affirmation must provide for private school officials to indicate the official’s belief that timely and meaningful consultation has not occurred or that the program design is not equitable with respect to eligible private school children. Nonpublic school should sign the documents indicating if they will participate or not.

Secular, Neutral, and Non-Ideological Funds may not be used to – Pay for programs designed to support religious instruction Used in any manner intended to advance or inhibit religion, or particular political views Help teachers to better evaluate students’ mastery of various religious precepts
