Primary Authority and Animal Establishment Licensing

Primary Authority and Animal Establishment Licensing Background to Primary Authority Primary Authority offers businesses the opportunity to form a legally recognised partnership with one local authority, which then provides robust and reliable advice for other councils to take into account when carrying out inspections or dealing with non- compliance.

Primary Authority and Animal Establishment Licensing The scheme is a common sense Government initiative to cut red tape and support economic growth through better local regulation. It is one of the most effective ways for local regulators to improve protection and support their business communities.

Primary Authority and Animal Establishment Licensing The principles of Primary Authority are set out in the Regulatory Enforcement and Sanctions Act 2008. The Enterprise and Regulatory Reform Act 2013, which received Royal Assent on 25 April 2013, amended the RES Act, broadening the eligibility criteria for participation in Primary Authority, and strengthening inspection plans. Supported by new statutory guidance, the scheme is now accessible to more small businesses and covers more regulations. It is administered by Regulatory Delivery (RD). This is where we come in. Conversation with BRDO, as then was at TS conference in 2013. Animal Establishments not in scope. So, they put them in scope.

Primary Authority and Animal Establishment Licensing Two types of PAP. Direct Co-ordinated – with trade organisations. Inspection Plan.

We hope to be signing up a major airline soon. But back to licensing

Primary Authority and Animal Establishment Licensing

Primary Authority and Animal Establishment Licensing Pet Animals Act 1951 Animal Boarding Establishment Act 1963 Dog Breeding Acts 1973, 1991 These two acts allow each LA to make reasonable conditions.

Primary Authority and Animal Establishment Licensing Model License Conditions The Acts that allow for conditions often have Model License Conditions. Dog and Cat boarding too.

Primary Authority and Animal Establishment Licensing Why were OATA and PIF interested in PAP’s? Inconsistency Unreasonable conditions Want meaningful inspections by knowledgeable people

Primary Authority and Animal Establishment Licensing Statutory Advice?

Primary Authority and Animal Establishment Licensing Benefits Dialogue Understanding the industry As the industry changes, so should the way it is regulated. Training opportunities Dialogue, not just with the industry, but also with the other LA’s. And with RD and BIS. Much better understanding of the trade through trade bodies. Multi-outlet operators want and demand consistency of approach to regulation and advice.
