Specific Learning Disability (SLD)Eligibility Training Introductions Christel Bogar and Ginger Meade- OVEC August 8, 2017

Learning Targets Participants will have a better understanding of the two methods KY districts may use to determine SLD eligibility Participants will be able describe the required evidence and where it may be located as part of SLD eligibility determination Participants will have a better understanding of how to document eligibility requirements identified on the SLD eligibility form Ginger

SLD Eligibility- Record Review Form Two Methods recognized by the Kentucky Department of Education Severe Discrepancy (SLD Tables) Response to Intervention Christel- Look at item 2 on the SLD record review document. The SLD tables must be used if the district selected Method A for determining eligibility. The SLD tables and the SLD Guidance Document are both located on KDE’s website under exceptional children-special education SLD guidance document will be revised in near future. Workgroup formed, but haven’t started yet.

SLD Eligibility- Record Review Form The ARC must review and analyze intervention and evaluation information MUST BE DOCUMENTED! (conference summary notes, eligibility form, multidisciplinary evaluation) Multiple Data Sources Christel- Meeting the tables alone or having RtI documentation is not enough to determine eligibility. Other sources of data need to be reviewed- formal observations, classroom, district, and/or state assessments, teacher and/or parent input, and outside evaluations (if appropriate) For re-evaluations, it is critical to provide evidence that the student has an adverse effect in the areas of concern. Cannot assume that there is an adverse effect. It is very important that the ARC discuss and document the data used to determine the student continues to be eligible for SLD.

Examples from Student Files Statements that student was in the average and above average in area of concern Continued eligibility in one area under SLD but dismissed in another area (lack of data to support why no longer eligible in that area) Statements that student made significant progress on goals, but unsure of the integrity of the data. Christel- Data must support that student is performing significantly and consistently below similar age peers.

SLD Eligibility- Record Review Form Vision, Hearing and Motor Screenings must be conducted for initial evaluations for SLD For re-evaluation, each exclusionary factor must be reviewed and documented by the ARC. Christel - Look at # 4 on the record review document and the SLD eligibility form. For initial, screeners for hearing, vision and motor are required. These must be reviewed by the ARC and included with referral documentation. What documents would the ARC review and analyze to address the other exclusionary factors?

Exclusionary Factors Multidisciplinary report (developmental history, cognitive assessments, formal observations) Office referrals/discipline reports Informal teacher observations/surveys (may include information and assessment data from EL teacher) Review and analysis of this information must be documented on the conference summary and/or eligibility form. Christel - For re-evaluation, the ARC must address each of these exclusionary factors prior to determining eligibility. Discuss with a neighbor how you might find evidence of these exclusionary factors (answers might include: formal observations, anecdotal notes, teacher input, others mentioned above)

SLD Eligibility- Record Review Form The ARC must discuss whether or not there are any relevant medical findings at initial evaluation and re- evaluations Discussion can be noted on the conference summary notes and/or eligibility form Ginger- If there are no medical concerns, this must be documented, in addition to the box being checked on the eligibility form.

SLD Eligibility- Record Review Form SLD # 10 a & b Initial Evaluations- RtI data and analysis Re-evaluations- Progress Monitoring data and analysis 707 KAR 1:300. Child find, evaluation, and reevaluation 707 KAR 1:310. Determination of Eligibility Christel- For initial evaluations, RtI data must be reviewed as part of the referral process. Upon eligibility determination, this data must be reviewed again. Can be documented in the multidisciplinary evaluation report, eligibility form, or conference summary. RtI process must document how information was shared with parents and that parents were informed that they may refer their child for an evaluation for special education services at any time. For reevaluations- Documentation must show that parents receive progress monitoring data and analysis (typically goes home when report cards go home). District will share any specific procedures they want to put in place for this item.

SLD Eligibility- Record Review Form 707 KAR 1:310 Section 2 (10) Only category that all members must sign whether or not they agree with decision. Required by law! Ginger- If a member of the ARC does not agree with the decision, they must submit a written explanation that is to be included with the documentation.
