Creates new Section (k) – Pilot Projects. Background Project No. 40150, PUC Rulemaking Proceeding Concerning an ERCOT Pilot Project: Amends PUC Subst. Rule § 25.361, Electric Reliability Council of Texas (ERCOT). Creates new Section (k) – Pilot Projects. Proposed rule as published would require ERCOT to: Designate which ERCOT rules will be subject to temporary exceptions Estimate costs of the pilot project Estimate completion date for the pilot project Rule approved for adoption at May 18, 2012 Open Meeting. ERCOT staff would seek ERCOT Board of Directors approval of pilot project for 30-Minute Emergency Response Service (ERS) at its June 19, 2012 meeting. June 7, 2012 ERCOT Public

Purpose of 30-Minute ERS Pilot Project Assess the operational benefits and challenges of deploying an ERS product with a 30-minute ramp period. Study the optimal means of deploying 30-Minute ERS within an Energy Emergency Alert (EEA). Gather data to analyze the operation and benefits of a clearing price mechanism. Gather data to assist ERCOT in determining the appropriate price to pay for 30-Minute ERS. Gather data to compare costs and benefits relative to 10-Minute ERS. Determine overall market interest in 30-Minute ERS before making appropriate ERCOT rule changes. June 7, 2012 ERCOT Public

Open to Loads (demand response) only 30-Minute ERS Features Open to Loads (demand response) only 30-minute ramp period following Dispatch Instruction Dispatched as early as EEA Level 1 Procured via market clearing price mechanism Tests will be designed to gain knowledge of fleet-wide Load performance Number of tests will depend on number of EEA events. Maximum of 8 hours of obligation, including tests No renewal Contract Periods 150 MW ceiling on procurement from competitive offers May be exceeded only by self-provided MW Consequence of non-compliance will be financial only No suspensions June 7, 2012 ERCOT Public

30-Minute ERS Additional Information At the end of a deployment event, ERCOT operators will have discretion on whether to recall 30-Minute ERS or 10-Minute ERS first or at same time. ERCOT will procure 30-Minute ERS under the $50 million ERS cost cap. ERCOT will conduct the 30-Minute ERS pilot according to the following schedule: Initial Contract Period: 07/15/12 – 09/30/12 Second Contract Period: 10/01/12 – 01/31/13 Third Contract Period (if necessary): 02/01/13 – 05/31/13 Contract Periods will ensure bridge between pilot and implementation of appropriate ERCOT rules. ERCOT Response to Comments Eligibility ERS Resources will be allowed to participate in both 10-Minute ERS and 30-Minute ERS during the same Pilot Contract Period but not during the same Time Period. Separately metered ESI-IDs and submetered Loads behind the same meter or Point of Interconnection will be allowed to offer some of these ERS Resources into 10-Minute ERS and others into 30-Minute ERS. ERS Resources can be offered into both 10-Minute ERS and 30-Minute ERS. ERCOT will develop a selection process to use during procurement. ERS Resources that are suspended due to 10-Minute ERS ramp violations may participate in Pilot upon successful completion of a 30-Minute reinstatement test. June 7, 2012 ERCOT Public

ERCOT Response to Comments Potential for Price Reversal 30-minute ERS will only be deployed during EEA Various solutions under stakeholder discussions concerning impacts to scarcity prices during deployment of out-of-market resources During non-scarcity conditions (test deployments) the impact should be minimal ERCOT reviewed some of the unannounced testing results for 2012 and found pricing impacts to be minimal during these tests which ranged from 120 – 340 MWs Timing of Procurement No adjustment to the pilot start date (July 15, 2012) Some additional time for QSE’s since ERID process will begin on June 8th June 7, 2012 ERCOT Public
