Export Control U.S. federal regulations involving exporting items and technologies (widgets, software, data, etc.) to foreign nationals, both on campus and abroad Meant to protect and “promote our national security interests and foreign policy objectives”

U.S. Export Control Regulations ITAR (International Traffic in Arms Regulations) State Department Military technologies; e.g. firearms, missiles, tanks and military vehicles but also include spacecraft & satellite technology Strictest of the regulations EAR (Export Administration Regulations) Department of Commerce Broader dual-use technologies; e.g. computers, marine technologies, sensors and lasers; and controls are very technology-specific OFAC (Office of Foreign Assets Control) Department of the Treasury Sanction programs are country specific and controls may cover any and all technologies and activities

What is an Export? Any shipment or transmission of an item(s) subject to the ITAR or EAR regulations out of the United States. Releasing (including oral or visual disclosure) technical data or software source code to a foreign entity in the United States (“Deemed Export”). Any method of disclosure may apply: email, telephone, websites, face-to-face discussions, training sessions, tours that involve visual inspections SPO Slide

Foreign Entity Any person who is not a lawful permanent resident of the U.S. (e.g., green card holder) Any foreign corporation, society or any other entity or group that is not incorporated or organized to do business in the U.S. Any foreign government

International Shipping Who will use the equipment/material overseas, i.e. who are the ultimate end-users? What foreign institution(s) are these people primarily affiliated with? What country is the ultimate destination for the shipment? What are you intending to ship? Please be detailed; no acronyms. What will be done with the equipment/material? Briefly describe the research. Will this equipment/material be used for any military purpose by the end-user or institution?
