DFO’s Fisheries Protection Program - Mandate The mandate of the Fisheries Protection Program is to maintain the sustainability and ongoing productivity of commercial, recreational and Aboriginal fisheries. 3 J. Stewart DFO

Technical Comments and Recommendations Fisheries and Oceans Canada’s comments are focused on the following areas: Aquatic Environment Mining of Additional Mineralized Zones Effects on Doris Lake Water Levels Water Levels Downstream of Doris Lake Discharge to Roberts Bay – Associated Infrastructure Roberts Bay Outfall Berm and Pipeline Other Infrastructure Changes Water Crossings 6

3.1.1 Effects on Doris Lake Water Levels Issue: Potential drawdown of Doris Lake as a result of groundwater inflow into proposed underground mine. Recommendation: Fisheries and Oceans Canada recommends that TMAC revise the Aquatic Monitoring Framework to include monitoring and reporting of water levels in Doris Lake and outflows. Fisheries and Oceans Canada recommends that TMAC establish water level thresholds beyond which localized effects to fish and fish habitat may occur that must be re- evaluated. 8

3.1.2 Water Levels Downstream of Doris Lake Issue: Additional studies are needed to determine whether potential impacts to water levels in Doris Lake will result in localized effects on fish populations downstream of Doris Lake that may require a Fisheries Act Authorization. Recommendation: Fisheries and Oceans Canada recommends that TMAC conduct the planned baseline fisheries studies in watercourses downstream of Doris Lake to confirm there are no residual negative impacts to fish and fish habitat. 9

3.2.1 Roberts Bay Outfall Berm and Pipeline Issue: The marine outfall berm and discharge pipeline that are proposed to be constructed in Roberts Bay may have negative impacts on fish and fish habitat. Recommendation: Fisheries and Oceans Canada recommends that TMAC provide the final detailed plans of the berm and pipeline construction for review during the regulatory phase. 11

3.3.1 Water Crossings Issue: The two proposed water crossings over fish- bearing streams may have negative impacts on fish and fish habitat. Recommendation: Fisheries and Oceans Canada recommends that TMAC provide detailed plans of all water crossing installations for review during the regulatory phase. 12

Conclusion Fisheries and Oceans Canada will continue to work with the Proponent and stakeholders, including potentially impacted communities, to ensure that: o Appropriate mitigation and monitoring programs are implemented; o Requested information is reviewed during the regulatory phase to ensure that there are no residual impacts on fish and fish habitat. 13
