DFO’s Fisheries Protection Program - Mandate The mandate of the Fisheries Protection Program is to maintain the sustainability and ongoing productivity of commercial, recreational and Aboriginal fisheries. 3 J. Stewart DFO

Fisheries Protection Program – Legislation Fisheries Act Section 35 Prohibits serious harm to fish Allows for authorization of impacts with conditions Section 20 Requirement for sufficient water, fish passage Species at Risk Act Sections 32, 33, 58 Prohibits killing, harming, harassing, capturing or taking of listed species, destruction of residence, critical habitat Nunavut Land Claims Agreement (Article 12 & 13 ) 4

Marine: Roberts Bay Outfall Berm and Pipeline Issue: Mitigation measures for construction and operation of the outfall berm and discharge pipeline. Response: TMAC to provide additional information on all applicable mitigation measures to Fisheries and Oceans Canada during regulatory process. Outstanding: None. 8

Freshwater: Doris Lake Water Levels 1 Issue: Additional studies required to determine spawning habitat location in Doris Lake. Response: TMAC provided additional data in response to Nunavut Impact Review Board technical review. Outstanding: None. New data to be reviewed in Final Written Submission to Nunavut Impact Review Board. 10

Freshwater: Doris Lake Water Levels 2 Issue: All mitigation measures should be explored to avoid and mitigate serious harm to fish in Doris Lake. Response: TMAC provided information in response to technical comments to the Nunavut Water Board. Outstanding: None. 11

Freshwater: Doris Lake Water Levels 3 Issue: Include monitoring of Doris Lake and outflow water levels in Aquatic Effects Monitoring Program Response: TMAC confirmed monitoring of water levels, will consider additional monitoring specific to potential drawdown of Doris Lake. Outstanding: None. 12

Freshwater: Doris Lake Water Levels 4 Issue: Potential impacts to Roberts Lake Outflow and any habitat offsetting measures related to Fisheries Act Authorization NU Response: TMAC provided information and additional data in response to Nunavut Impact Review Board technical review. Outstanding: None. New data to be reviewed in Final Written Submission to Nunavut Impact Review Board. 13

Freshwater: Water Crossings Issue: All available best management practices in water crossing construction, operation and decommissioning, detailed plans to be provided before construction. Response: TMAC commits to providing all plans and using all feasible best management practices. Outstanding: None. 14

Conclusion Fisheries and Oceans Canada will continue to work with the Proponent and stakeholders, including potentially impacted communities, to ensure that: o Appropriate mitigation and monitoring programs are implemented; o Any required Offsetting Plan is adequate; o Any inadequacies of new information are addressed. 15
