What is CUPA? Certified Unified Program Agency

Health & Safety Code Chapter 6.11  Consolidated six existing hazardous materials and hazardous waste regulatory programs to improve coordination and consistency.  California Environmental Protection Agency (Cal/EPA) certifies and regularly evaluates the local agencies that enforce the Unified Program for compliance with established statutory and regulatory standards. 3

Certified Unified Program Agencies (CUPAs)  There are 83 CUPAs and 33 Participating Agencies (PAs)  Prior to the creation of the Unified Program, the six program elements were implemented by over 1,300 separate state and local agencies. 5

6 CUPAs  Implement and enforce the Unified Programs which are mandated by law to ensure that:  Business with large quantities of toxic gases have release prevention plans.  Hazardous wastes are properly managed.  Hazardous materials in facilities throughout California are accurately reported, catalogued and disseminated to emergency responders and the public.  Above and underground tanks storing hazardous materials have adequate leak detection and containment equipment to protect the waters of the state.

CUPA Forum Objectives  To work with all parties, both internal and external, to develop guidance, regulations, and policies regarding CUPA administration.  To establish positions on statewide issues affecting CUPAs and provide a unified response to such issues.  To coordinate information exchange between CUPAs and the State on statewide issues.  To assist in making training available to CUPAs.

12 Program Implementation  CUPAs promote and support:  Partnerships with various industry and environmental protection advocacy groups  Educational workshops  Web site outreach  Outreach materials  An inspection program that is mandated by law to have a graduated enforcement policy.  The education, outreach and inspection programs effectively and efficiently reduce environmental risk without a significant reliance on formal enforcement.
