NEW LEGISLATION (1) The decision was made – according to the revised Law “On Electronic Communications” the asymmetrical regulation will be applied for NGA Specifics: before the new market analyses round will be done, all previous remedies for SMP operator will be in force. Market No 4 – LLU (technologically neutral) Market No 5 – Broadband

NEW LEGISLATION (2) Updated or elaborated Regulations by PUC The information to be included by SMP operator in the Reference Offer (1) (LLU metal or fibre including terminating segment specific information) Type of line (type of access) Geographical place or address (if this information is not confidential) Collocation geographical place or address and collocation possibilities Number or spare pairs or fibres to be used for maintenance only

NEW LEGISLATION (5) Updated or elaborated Regulations by PUC Technical requirements and procedures for LLU including terminating segment (1) The set of technical requirements is the same as in Reference Offer, but there are some additional parameters as line codes, signal levels, the waves length for the optical signal or frequencies. In such cases both sides have to find a “common language” The procedure how to apply for LLU is detailed – the applicant has to fill in the application form:

NEW LEGISLATION (6) Updated or elaborated Regulations by PUC Technical requirements and procedures for LLU including terminating segment (2) a.Planned number of customers or lines with addresses b.Planned technology or technical solutions c.The type of access according to classification d. Planned line code, waves length, frequency, transmission levels etc. if applicable e.The applicant equipment i.e. switching, transmission etc. if applicable

NEW LEGISLATION (7) Updated or elaborated Regulations by PUC Technical requirements and procedures for LLU including terminating segment (3) The owner of the network may ask from the applicant the information only if it is necessary to prepare the agreement or to arrange the testing of the unbundled loop Applicant and the owner of the network may create common working group for the LLU technical possibilities testing if necessary

NEW LEGISLATION (8) Updated or elaborated Regulations by PUC Technical requirements and procedures for LLU including terminating segment (4) No later than after 20 days the owner of the network has to send to applicant the decision “YES” or “NO”. If “NO”, the decision has to be explained. Test protocol with technical details will be amended to decision (If the working group was established, both sides have to sign this protocol) The agreement between both sides has to meet minimal requirements included in Regulation

NEW LEGISLATION (9) Updated or elaborated Regulations by PUC Technical requirements and procedures for access to associated facilities and services (1) The structure of this Regulation is similar to Regulation On “Technical requirements and procedures for LLU” The classification of associated facilities is included in Regulation The set of technical requirements is the same as in in Reference Offer, but there are some additional parameters:

NEW LEGISLATION (10) Updated or elaborated Regulations by PUC Technical requirements and procedures for access to associated facilities and services (2) a.Maximum cable diameter allowed to install in the duct depending on free capacaty of duct and requirements for marking b.Maximum sizes, weight, electrical power and EMC requirements if applicable for cable distribution facilities Similar requirements are for MDF, ODF, towers, masts, technical premises etc.

NEW LEGISLATION (11) Updated or elaborated Regulations by PUC Technical requirements and procedures for access to associated facilities and services (3) The application procedure is similar to LLU, only some technical details are different The main difference is – instead 20 days for making decision the owner of faculties is obliged to make a decision no later than after 14 days The agreement between both sides has to meet minimal requirements included in Regulation

NEW LEGISLATION (12) Regulation updated by Ministry The draft of Regulation which sets requirements for the electronic communications networks planning, design, construction, installation and supervision is elaborated The discussion about this document continues just about six months BECAUSE Public Utilities Commission asked to include this document the following obligations for every operator:

NEW LEGISLATION (13) Regulation updated by Ministry a.When the network planning and designing was started the responsible operator has to publish information where the digging will be arranged b.All interested parties (i.e. operators) have to be invited to take part in planning, designing and construction works – the reason to share costs. The invitation is in force 1 month c.Planning and designing the ducting system the responsible operator is obliged to meet n+1 principle

NEW LEGISLATION (14) Regulation updated by Ministry d. n+1 principle means to install one duct more between manholes with the same diameter that the operator needs for its own purposes. The reason is other operators may rent this duct to install their fibre optics cables e. n+1 principle covers: - cities with population > inhabitance - all other places if the asphalt surface has to be opened - in the narrow places if it is not possible to establish more than one cable protection zone

INFORMATION SYSTEMS (1) TEMPORARY SOLUTIONS If you want to start network planning and design and want to know somebody else does the same job in the same place – look for webs in particular municipality, because they are obliged to publish such kind of information. In future National Construction Work Portal (BIS) supported by the Ministry of Economy will be established The same procedure is if you want to know who started the construction work in the particular municipality

INFORMATION SYSTEMS (2) TEMPORARY SOLUTIONS If you want to know where, which operator has the ducting system in places you are interested, free capacity of ducts, manholes, cable cabinets, etc. two steps should be done: a.ask the municipality for location and owner of facilities (municipalities have information only about owner and location) b.ask the operator about all details concerning the capacity, types of cables etc. According to the Law “On Electronic Communications” operators are obliged to provide this information during 10 working days

INFORMATION SYSTEMS (3) TEMPORARY SOLUTIONS CONCLUSION The existing system is slow un non convenient The future BIS system will solve problem if it will be real cooperation with municipalities, because gas, water, electricity, heating companies have similar problems with underground infrastructure The E-mapping will help to build the system To create the proper system will cost money, but it will help to every operator (not only telecommunications), state and municipal institutions
